An unannounced case management inspection was conducted on this date by Licensing Program Analyst (LPA) Carmen Odom in response to a self-reported incident dated 6/7/23. Present during today’s inspection was the Director Perla Arrieta. At 9:00am census was taken in individual classrooms. The overall census observed was 39 preschool age children and 5 staff members.

A review of adult records indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 6/7/2023 an Unusual Incident Report was filed with the Department to self-report an incident that occurred on 6/6/2023. Director reported that on 6/6/23 at 5:47pm parent of Child #1 (C1) spoke to Staff #2 (S2) regarding what C1 had disclosed about Staff #1 (S1). C1 disclosed to adult #1 (A1) that S1 had pulled C1’s hair on the morning of 6/6/23. S2 told parent that they would conduct an internal investigation regarding the allegation.

During the investigation, LPA obtained personnel report, children’s roster, interviewed 2 staff, 5 children and reviewed records obtained. Staff #2 (S2) stated they immediately notified their supervisor regarding the allegation so they can review the video recording of the classroom. S2 was informed by their supervisor that they did not observe S1 pull C1’s hair according to video recording on 6/6/23. S2 interviewed S1 and child #2 (C2) on 6/7/23 regarding the incident. S2 disclosed according to the interviews conducted C1 had pulled C2’s hair and S1 spoke to C1 regarding their behavior. S1 stated on the morning of 6/6/23 C1 pulled C2’s hair and S1 told C1, “would you like your hair pulled?” S1 pointing on the top of their head, in that moment A1 walked into the classroom and C1 ran to A1. S1 denied the allegation. S1 stated the way they discipline the children is by talking to them and if the behavior continues S1 will sit with the child for 5 minutes to talk about why they are separated from their friends. C1 did not disclose S1 pulling their hair. Four other children that were interviewed disclosed that C1 does pull children’s hair and will also push and lick them. None of the children disclosed observing S1 pulling C1’s hair or any other child.

Statements made by staff and children indicate that S1 did not pull C1’s hair. Reporting requirements were met. Based on LPA observations, interviews conducted, and records/documentation reviewed, there is no evidence to support any violation of Title 22 regulations. No Title 22 deficiencies cited during today's inspection.

Exit interview was conducted with Director Perla Arrieta. Notice of Site Visit was posted during the inspection. Facility representatives was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Facility representatives was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
