On 7/8/2024 Licensing Program Analyst (LPA) A. Silva conducted an unannounced complaint investigation. Upon arrival, the LPA met with Director Cynthia Moreno and informed the director of the purpose of the visit. A review of the Facility Personnel Report Summary shows all facility staff or individuals who require caregiver background checks have received a criminal record clearance and a child abuse index clearance or an exemption clearance. The census at the time of the visit was 41 preschool children.

The Department received a complaint on 7/1/2024 alleging that staff did not promptly give parents a copy of the report dated 6/26/24, which documents one Type A citation.

On 7/8/24, the director confirmed that the school was open and caring for children during normal business hours on June 26, 27, and 28.

On 7/8/24, School Education Manager (SEM) Deepal Parikh and Director Cynthia Moreno corroborated that SEM Deepal was present working during normal business hours on June 27 and 28.

On 7/8/24, the LPA observed signed copies of the LIC9224 organized by classroom. There was a total of 62 signed copies for six classrooms, all of which were dated 7/1/24 or later. During this visit, the LPA obtained copies of the children's attendance records for June 26, 27, and 28, 2024. The records show that the total attendance was 80 children on 6/26, 79 children on 6/27, and 81 children on 6/28.

On 7/1/2024, the LPA interviewed the Reporting Party (RP) who stated that, as of this date, the facility had not reported a type A deficiency to parents of children currently attending. RP provided the names and contact information of witnesses.

On 7/1/24 during confidential one-on-one interviews, three witnesses stated that the allegations were true. All three witnesses stated that the licensing report had not been provided to parents as of July 1, 2024.

On 7/1/2024, the LPA interviewed Director Cynthia Moreno over the telephone. The director admitted that a copy of the licensing report had not been given to the parents of children currently enrolled. According to the director, the report had not been provided to the parents because she was out on vacation.

On 6/26/2024, the LPA received two LIC308 Designation of Responsibility forms. One of the forms was for SEM Deepal. It has been established that Deepal was supervising the school on June 26, 27, and 28, 2024, which demonstrates that an authorized staff was available and able to carry out the reporting requirements promptly.

On 6/26/24, The LPA reviewed the licensing report in question with SEM Deepal Parikh. The LPA explained to Deepal that a copy of the licensing report must be provided to parents or guardians of all clients currently enrolled by the next business day or by the next day the children are in care. Deepal received a copy of the LIC9224 partially filled out by the LPA. Deepal said they understood the reporting requirements and signed the report.

Based on observations, records, and interview statements, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. A substantiated finding means that the complaint is substantiated, and the allegation is valid.

An exit interview was conducted with Director Cynthia Moreno. The Notice of Site Visit was posted during the visit. The director was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First-level appeals should be sent to the regional manager to the address listed above.
