32 | On 08/25/22 LPA spoke with Director, Ms. Kasparian, who stated that two outlets had ALE over 5.0 had been made inaccessible to children via, signs posted stating DO NOT USE. Outlets A, B, C, J, K,L, M, and N were viewed based on the facility sketch. Outlet C had a level of 82.4 and is located in the infant closet and is not in use and that space is used for storage. It has a sign that stating DO NOT USE. Outlet M had a level of 19.0 and is located in classroom with a sign stating DO NOT USE. Outlet D had a level of 10.3 is located outside in the playground. Outlet E had a level of 11.1 is located in the hallway and is drinking fountain. It had a sign stating DO NOT USE. Staff use water from the sink that tested no high levels of lead. Outlet N is located outside in the playground. No other physical outlets were viewed, Director will obtain information from the water testing company where outlets C30, D30, E30, M30 are located via email. Director reports that faucets will be repaired and or replaced after flushing. Drinking fountain will be permanently closed off and eventually removed. Director stated they use the sink in their classrooms as alternate water sources, which passed with no high levels of lead. Children also bring their own water bottles as a drinking source and facility provides bottled water as well.
Based on LPAs Director interview, review of facility sketch and walk-through, the following violation was observed and is being cited in accordance with California Code of Regulations Title 22, Division 12, Chapter 3, Section 101238(a) Buildings and Grounds is being cited on the attached LIC 809D.
Exit interview conducted with Director, Dana Kasparian. The report was reviewed and discussed. Appeal Rights were discussed. Facility staff was provided copy of their appeal rights (lic 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received the Regional Office within 15 business days.
The staff was informed that the "Notice of Site Visit" must be posted for 30 consecutive days. The Notice of Site Visit must be posted on or adjacent to the door. Failure to post will result in Civil Penalties of $100.00.
