32 | On 04/03/24 the Orange County Child Care Office received a complaint alleging Facility staff are operating beyond the terms of the license. Reporting Party (PR) stated as of April 1, 2024, Child#1(C1) who is not 2 years old is officially in the 2 year classroom.
During the investigation, LPA interviewed 4 staff members, obtain a copy of the children's roster, and reviewed children’s files.
On 4/9/24 LPA Nunez interviewed 4 staff members. 3 out of 4 staff members stated C1 was placed in the 2 year old classroom on April 1, 2024. Staff#4 (S4) stated C1 is going to turn 2 on April 19. Staff#3 (S3) stated the youngest child in their classroom is C1 that will be turning 2 years old on April 19. S3 stated C1 was placed in the 2 year old classroom due to C1’s parent liking a certain teacher in the classroom. Staff#2(S2) stated that C1 was placed in the 2 year old classroom because S2 thought C1’s birthday was on March 19 and S2 believed that C1 was already 2 years old.
On 4/9/24 LPA Nunez reviewed C1’s file and it was confirmed that C1 is under 2 years old. LPA Nunez also obtained a copy of the children’s roster and it is confirmed that C1’s name is on the 2 year old classroom roster.
LPA Nunez was not able to interview children in the 2 year old classroom due to their age and being non-verbal.
On 6/12/24 LPA attempted to interview 8 parents however only 2 parents were available for interviews. The 2 parents were satisfied with the childcare center.
Based on staff interviews and record reviewed it has been determined that the Facility staff operating beyond the terms of the license. The preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division & Chapter 12, is being cited on the attached LIC 9099D for the deficiency Section 101161(a) Limitations on Capacity.
Exit interview conducted and report was reviewed with Director Ruby Cabrera. Notice of site visit was given and must remain posted for 30 days. Failure to comply with the posting requirements shall result in an immediate civil penalty of $100.
