Licensing Program Analysts (LPA) Aiddee Nunez conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 04/09/2024. Upon arrival LPA met with Director Ruby Cabrera, to deliver complaint findings. The children were napping when census was taken and observed a total of 6 toddler age children in the toddler option program with 1 staff member. A total of 71 preschool age children with 7 staff members were observed in the preschool classrooms.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios

On 04/26/24 the Orange County Child Care Office received a complaint alleging Staff did not provide adequate food service. Reporting Party (RP) stated Staff #6 (S6) warms up the children’s lunches too early that by the time it’s time for lunch their food is super cold. RP stated that Child#1 (C1) stated that C1’s food wasn’t good because it was cold. RP stated this is an ongoing issue it’s an everyday day thing. They do their warm up’s too soon for every classroom. RP stated their child does not receive milk with their lunch that is always cold. RP stated they pay $5 extra for the facility to provide lunch. RP stated the portions are very small and can be observed in photos posted on their Homeroom app. RP stated they serve 2 apple slices and spinach or carrots.

During the investigation, interviewed 7 staff members, 5 children, and 2 parents. LPA also obtain a copy of the personnel report, children's roster, and their lunch menus. LPA went inside 3 classrooms (Preschool 2, Preschool 3, and Preschool 5) to observe the children’s lunches. LPA was provided with pictures of children’s lunches.

On 5/2/24 LPA Nunez interviewed 6 staff members. All staff members stated children that bring their own lunch from home, staff will put the children’s lunches on trays and office staff will pick up the lunches and will heat them up in the microwave. The office staff will then deliver the lunches. S6 stated the toddler children will get their lunches heat up first and deliver them first as well. The toddler children will eat their lunches right away. Staff# 2 (S2) stated front staff brings the children lunches around 11:40am and children will eat their lunch around 12pm. S2 stated no child has complaint about their food being too cold and the children are old enough to tell S2 if the food is cold. Staff#3 (S3) stated that when lunches are brought to the classroom the children will eat their lunch right away. S3 stated if the food is cold the children will let S3 know about the food being cold. Staff#4 (S4) stated when office staff bring the food to the classroom. The children will eat the food about 20 minutes later. S4 stated children have complaint that their food is cold and S4 will call the front staff and they will pick up the food and reheat it.

On 5/2/24 LPA Nunez went inside 3 classroom and observed the children’s lunches that were provided by the facility. LPA did not observed children being served milk with their lunch. LPA asked the Staff#7 (S7) if milk is provided to the children and S7 stated no. S6 also confirmed that the children are not provided milk with their lunch. 3 staff members also disclosed that the facility does not provide enough food for the children. S1 and S4 stated the facility will only provide 2 chicken nuggets and 2 pieces of apples and the children will complaint that they are hungry. Staff#5 (S5) stated the facility will buy one box of chicken nuggets for the whole school. LPA was provided with pictures of children’s food and on the pictures, it showed half a hot dog with 3 slices of cucumbers and in another plate, it showed half a hot dog with 2 slices of apples.

On 5/2/24 LPA Nunez interviewed 5 children. 4 out 5 children stated their food is warm when they eat their lunch.

On 6/12/24 LPA attempted to interview 8 parents however only 2 parents were available for interviews. The 2 parents were satisfied with the childcare center.



Based on staff interviews and record reviewed it has been determined that the Staff did not provide adequate food service. The preponderance of evidence standard has been met; therefore, the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division & Chapter 12, is being cited on the attached LIC 9099D for the deficiency Section 101227(a)(1)(A)(2) Food Service.

Exit interview conducted and report was reviewed with Director Ruby Cabrera. Notice of site visit was given and must remain posted for 30 days. Failure to comply with the posting requirements shall result in an immediate civil penalty of $100.

The director stated will buy the appropriate food groups. The director stated she will follow the food componet chart when serving the children's lunches. The facility will provide milk to children during lunch time. The director will provide a written statement to the LPA by the POC due date.

Based on LPA’s observation and interviews, during lunch time the facility does not provide children with milk. 3 staff members also disclosed that the facility does not provide enough food for the children. This poses a potential risk to the health and safety of children in care.
