Licensing Program Analysts (LPA's) Thompson and Duron conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 2/22/2023. Upon arrival LPA met with Administrator Monica Ramirez, to deliver complaint findings. Monica Ramirez guided LPA on a tour of the facility. LPA observed a total of 98 Prescool age children with12 staff.

A review of the Facility Personnel Report Summary indicates all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 2/16/2023 a complaint was received alleging Staff are leaving day care child in soiled diapers/clothes.

During the investigation LPA interviewed Administrator, six staff, three children, three parents, and obtained the facility roster.

During the investigation, Administrator was interviewed on 2/22/2023. Administrator was asked by LPA, what is the policy when preschool age children have accidents or soil their clothing? Administrator stated, the policy is to get them cleaned right away so they are comfortable. Soil clothing is then placed in a plastic bag inside the bathroom and parents are notified.

On 2/22/2023 six staff interviews were conducted. All six staff was asked by LPA, what is the policy when preschool age children have accidents or soil their clothing? All six staff knew the policy and had similar answers. Staff stated they change the children's clothing, placed the soiled clothing in plastic bags, and notify the children's parent through the messaging app.

On 2/22/2023 LPA asked six staff, Have you ever been informed to leave preschool children in soiled clothing? All six staff answered "no." One staff stated they have been told to just tell the children to clean themselves. When LPA asked the name of the staff, the staff said they were Informed by the teacher in the classroom and did not know the name of the teacher.

On 2/22/2023 LPA asked six staff, Have you ever witnessed Preschool children being left in soiled clothing after having an accident? Five out of Six staff answered "no." One staff stated "Yes, A few hours sometimes up to 3 hours toward the end of day..

On 2/22/2023 LPA interviewed three children who were qualified to be interviewed. Children interviewed stated when accidents happen, teachers help them. One child stated, the teachers help and put dirty clothing inside a plastic bag.

On 2/23/2023 LPA interviewed three parents who all had nothing but positives things to say about the care and supervision their children receives. All three parents stated they have never picked up their children with soiled clothing and if an accident happens they are notified by staff. There were no disclosures from the parents interviewed regarding the allegation mentioned.

Based on LPA interviews with Administrator, Six staff, three children and three parents, it was determined there was insufficient evidence that staff are leaving day care child in soiled diapers/clothes. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is Unsubstantiated.

Exit interview was conducted with Administrator Monica Ramirez. Notice of Site Visit was posted during the visit. Licensee was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Licensee was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
