Licensing Program Analyst (LPA) Patricia Duron conducted an unannounced complaint visit to deliver the complaint findings. This is a continuation of the investigation initiated on 12/18/24, LPA met with Director, NAME and informed the director of the purpose of the visit. The director guided LPA on a tour of the facility and a census was taken. The overall census observed was 1 preschool staff and 5 preschool children.
A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 12/17/24 a complaint was filed with the Licensing office alleging: Reporting requirements for new director.
During the course of the investigation, LPA interviewed 4 staff members, 2 children and 4 parents, and reviewed records.

LPA interviewed 4 staff, 4 out of 4 staff stated new Director started in October 2024. Staff #3 (S3) stated, the new director submitted director’s packet to Staff #5 (S5) in October 2024. S3 stated, S5 must have not submitted packet to Analyst or the Community Care Licensing Office.

LPA confirmed with facility’s analyst, they had not received director’s packet for current director.

LPA Duron interviewed 3 children. All children interviewed made no disclosures regarding the above allegations.

LPA Duron interviewed 4 parents. All interviewed parents stated they did not have any concern with facility.


Based on LPA’s interviews, the preponderance of evidence standard has been met, therefore the above allegation has found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101212(b) Reporting Requirements is being cited. Please refer to attached 9099D for documentation of deficiencies.

This requirement is met as evidence by: Based on LPA’s interviews and record review, 3 out of 3 staff stated new director started in October 2024. Staff #3 (S3) stated new director submitted the new director’s packet to S5, yet S5 did not inform the facility’s Licensing Program Analyst (LPA) or the Community Care Licensing Office of updated changes, which poses a potential health risk to the children in care.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department.



The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door.

visit to deliver the complaint findings for the above allegations. This is a continuation of the investigation initiated on 12/18/24, LPA met with Director, Jennifer House and informed the director of the purpose of the visit. The director and LPA observed classrooms and census was taken. The overall census observed was 1 staff and 5 children.
A review of staff records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 12/17/24 a complaint was filed with the Licensing office alleging (1) Unqualified staff and (2) Staff yanked a child. Reporting Party (RP) stated facility is not screening the teachers well due to shortness of staff and S1 yanked C1.
During the course of investigation, LPA interviewed 3 staff members, 3 children and 4 parents, and reviewed records.

Regarding allegation (1) Unqualified Staff

LPA interviewed 3 staff members, 3 out of 3 staff members stated they have the required qualifications for their positions. During the investigation on 12/18/24, LPA reviewed preschool staff member’s files and verified preschool staff meet the qualifications for their positions.

Regarding allegation (2) Staff yanked a child

LPA interviewed 3 staff members, 3 out of 3 staff members stated they have not witnessed staff yank a child. 3 out of 3 staff stated they have not witnessed Staff #1 (S1) yank Child #1 (C1).

During the investigation dated 12/18/24, LPA reviewed preschool staff member’s files and verified each preschool staff member meet the qualifications for their position.

LPA Duron interviewed 3 children. All 3 interviewed children made no disclosures regarding the above allegations.

LPA Duron interviewed 4 parents. All interviewed parents stated they did not have any concern with facility.



Based on the information gathered from LPAs’ interviews, observation, and the reviewing of records, there are insufficient evidence to corroborate the allegations: Unqualified staff and staff yanked a child.
Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegation is UNSUBSTANTIATED.
