The Department received a complaint on 05/06/25 alleging (1) Child sustained bruises while in care. (2) Child was not allowed to use the restroom.
On 5/6/2025, LPA interviewed reporting party (RP). RP stated that Child #2 (C2) sustained bruises while in care and C2 was not allowed to use the restroom. LPA interviewed child#1 (C1) and C2. C1 stated Staff #5 (S5) grabbed C2 by the arm that resulted to C2’s arm being bruised. C1 stated the facility refused C2 to use the bathroom.
On 5/8/2025 and 5/14/2025, LPA interviewed staff at the facility. Staff stated they did not witness staff # 5 (S5) inflict bruises to C2. Staff stated they do not prevent children from using the restroom. Staff stated there is a restroom in the hallway for children and another restroom in the school age classroom.
On 5/8/2025 and 5/14/2025, LPA interviewed children at the facility. Children stated S5 is their favorite teacher because S5 is nice and fun. Children stated they are always allowed to use the restroom. Children pointed and showed LPA the restrooms they use which are in the hallway, and in the classroom. Children stated that sometimes teacher would tell them to wait for their turn in the restroom.
LPA called parents, none of the parents interviewed disclosed information that could support the allegations.
Based on LPA’s observation, children would swarm and hug S5 when S5 enters the classroom. LPA also observed teachers would ask if children need to use the restroom. LPA observed teachers stands between the door of the classroom or playground and the hallway to supervise children using to the restroom.
Based on observation and interviews, although the allegation may or may not have happened, the preponderance of evidence standard has not been met, therefore the above allegation is found to be UNSUBSTANTIATED.
Exit interview was conducted with staff Shilpi Sharma. Report was reviewed and discussed. Notice of Site Visit was posted during the visit. Staff was informed that the notice of site visit must be posted for 30 consecutive days. Appeal Rights provided.
