32 | The child got a red mark on his forehead, and parents were informed. Staff #3 (S3) stated parents were contacted, and the child had a small scratch, but child was ok.
Regarding the allegation of “Facility is covering the crack in the floor with duct tape”, LPA observed duct tape on the floor in classroom #3 and classroom #4 during initial visit conducted on 4/20/23. Staff #1 (S1) stated room #3 does have duct tape on the floor, to cover the crack, about 1 year tape is still there. S1 stated the facility is planning to make repairs to floor and other things in the classrooms. Staff #2 (S2) stated in room 3 the duct tape is on the floor.It's on the floor where they eat because there is a crack on the floor. Staff #4 (S4) stated the duct tape in room #4 is used for a guide for children when it’s time to line up. LPA observed duct tape in Room #4 on floor, and no visible cracks were under the tape. S4 stated the duct tape in room #3 is used for children to line up, but other tape is to cover the cracks that are on the tile in room #3. S4 stated remodeling and adding new flooring in the classrooms will be taking place.
LPA Duron interviewed 4 parents. All interviewed parents stated they did not have any concern with facility.
Based on LPA’s interviews, observations and reviewing records, the preponderance of evidence standard has been met, therefore the above allegation is are found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1 Section 101238 Buildings and Grounds (a) and 101229(a)(1) Responsibility for Providing Care and Supervision are being cited on the attached LIC9099D.
This requirement is met as evidence by: Based on LPA’s observations of the floor at the facility did have duct tape on the floor covering cracks on the floor. Based on LPA’s interviews 3 out of 4 staff stated facility does have duct tape on the floor for the purpose of covering the cracks on the floor. 3 out of 4 staff stated bulletin board did fall on a child in care, which poses a potential health risk to the children in care.
An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department. The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door. |
