32 | On 06/27/24 the Orange County Childcare Office received a complaint alleging Facility is operating out of ratio. Reporting Party (RP) stated the facility is understaffed causing them to be out of ratio. RP stated on 06/26/2024, RP observed 20 children and two (2) staff in the toddler option program room.
During the investigation, LPA Nunez conducted a facility inspection, interviewed 6 staff members, reviewed files, and obtain copies of the children’s roster, staff timecards, and children’s sign in/out sheets. Children were not interviewed due to their age and being non-verbal. On 7/8/24, LPA received the personnel report via email from the director.
On 7/1/2024, LPA interviewed 5 staff members. Staff#1 (S1) stated S1 has 11 toddlers enrolled. S1 stated the most toddlers S1 has had at a time is 10 toddlers with an assistant present. S1 stated S1 has not been alone with more than 6 toddlers. S1 is a qualified teacher with 12 ECE units including infant/toddler courses. Staff#2 (S2) stated when S1 leaves the facility, S2 was left alone supervising no more than 6 toddlers option children. S2 stated S2 has 9 ECE units but will complete the 12 ECE units in the month of July 2024. LPA reviewed S2 file and observed 9 ECE units in S2 school transcripts. Staff#4 (S4) stated S4 cannot be alone with the toddlers because S4 is currently taking 3 ECE units. S4 stated S2 will stay with the toddlers when S1 leaves the facility. S4 stated S4 will go in the toddler option classroom to assistant S2 when S2 has more than 6 toddlers. Staff#5 (S5) Also, stated when S1 leaves the facility S2 will take over the toddler option classroom. On 7/1/2024 at 9:14am when LPA arrived, LPA observed 6 toddlers with 1 staff member. LPA reviewed the children’s sign in/out sheets for 06/26/2024 and observed 6 children signed in and out in the sign in/out sheets.
On 8/15/2024, LPA called 8 parents and was able to interview 1 parent. The parent did not have any concerns with the facility.
Based on LPA’s record review, staff members, and parents interviews it was determined there was insufficient evidence that facility is operating out of ratio. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations is Unsubstantiated.
Exit interview was conducted with Director, Atosa Zadeh. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
