A complaint inspection was conducted on this date by Licensing Program Analysts (LPAs) Cindy Nguyen and Alma Castro, in response to the above allegation. This is a continuation of the investigation initiated on 05/02/2024. LPA met with Area Director Maria Rodriguez who accompanied LPA on a tour of the facility. Census was taken as follow: 14 school age children with 1 staff member. During today's inspection staffing and capacity ratios were met. A review of staff criminal records indicates all facility staff or individuals who require caregiver background checks have received a criminal record clearance or exemption and a child abuse index clearance.

On 04/30/24 a complaint was filed with the Licensing Office. Complainant alleged licensee does not ensure that the facility is free from pests. Complainant stated that facility has rats however, the licensee is not addressing the matter. Complainant observed rat remains twice in the child’s blanket. The problem has been going on for a long time and the licensee is not doing anything about the problem. Complaint also stated complainant observed a rat crawling out of the front desk before. During the investigation, LPA conducted two physical plant inspection, interviewed 3 staff members, 3 children, obtained pest control service agreement and a copy of the children's roster. LPA was unable to interview the complainant due to no contact information provided.

During the staff interviews, all three staff admitted the facility has rodents and have observed droppings in the facility. Pest control service was called for service on 04/02/2024 and set up for an ongoing service.

LPA reviewed pest control service agreement, which stated entry points for rodents were sealed off around the building.

During the inspection on 05/02/2024, LPA observed droppings around the children’s cubby area, and the couch area of the middle classroom. During the children’s interviews, all three children admitted they have observed rats at the facility.

Based on LPA observations, review of pest control service agreement, and interviews with staff and children, the preponderance of evidence standard has been met; therefore, the above allegation found to be SUBSTANTIATED. California Code of Regulations, Title 22 Buildings and Grounds 101238 (a)(1) was cited on the attached LIC 9099D.

Exit interview was conducted with Area Director, Maria Rodriguez. Report reviewed and discussed. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Appeal Rights and deficiencies were discussed. Director, Maria Rodriguez was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

Area Director stated they will provide a written preventative maintenance plan and removed the rat remains on the ceiling in the middle classroom by sending a picture to the licensing department by 06/19/2024.
