Licensing Program Analyst (LPA) Patricia Duron conducted an unannounced complaint visit to deliver the complaint findings. LPA met with director, Mabell Alcantar and census was taken. The overall census observed was 1 staff and 5 preschool children. A review of staff criminal clearance records on this date indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 10/26/2022 a complaint was filed with the Licensing office stating staff did not prevent inappropriate behaviors between day care children, staff did not notify day care child’s parents of incidents, and staff are not making sure day care children get something to drink. Report party (RP) stated the following: the children were kicked in the face and had a slight bruise under the eye. Children were also had dirt kicked on the face and parents were not notified about the incidents.

During the course of the investigation, LPA interviewed Director, 3 staff, 5 children, 3 parents, and reviewed records.

During the initial inspection dated 11/01/22, LPA observed the following: staff supervising children inside and outside the facility. LPA observed facility was in ratio. Water coolers along with paper cups available in each classroom and outside for outdoor play. Children had individual sports water bottles readily available.

LPA reviewed incident reports copies which are provided to authorized representatives.

During the staff interview, the interviewed staff stated the following: If the children get hurt, they would assess the injured, clean it with water, and apply band aid. Staff then fill out the “ouchie report” and inform the parents. Staff stated water dispenser and paper cups are available to children in each classroom and outside. Some children bring their own water bottles and they can fill their water bottle from the water dispenser. All interviewed staff denied witnessing any children being kicked in the face by another child and receiving a bruise from kick. Staff did not witness a child having dirt kicked in their face by another child.

During the children interview, the children stated the following: If the children get hurt, the teachers would help them clean it, give them ice and band aid. No children witnessed any child get hurt. When they play inside or outside, the teachers are present to watch and supervise children. 2 out of 5 children stated the teachers would tell their parents if they get hurt.

LPA Duron contacted five parents by phone and was able to interview three parents. All interviewed parents stated they did not have any concern with facility.

Based on the information gathered from LPAs’ interviews, observation, and reviewing records, there is insufficient evidence to corroborate the allegations of Staff did not prevent inappropriate behaviors between day care children, staff did not notify day care child's parent of incidents, and staff are not making sure day care children get something to drink.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day care facility, therefore the allegations are UNSUBSTANTIATED.

An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days. Any proposed changes to the physical plant, including telephone number, shall be immediately reported to the Department.



The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door.
