Licensing Program Analyst (LPA), Giselle Lucero conducted an onsite inspection for the purpose of an Annual Random. LPA toured the facility inside and outside. The floor and yard plan (LIC 999) were verified. Census was taken. LPA observed a total of 4 preschool age children with 1 staff. Facility hours are Monday through Friday, 7 AM to 6 PM.

During the inspection it was determined the facility is operating within its licensed capacity and within compliance of staffing ratios. A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

During the inspection of the indoor activity space, LPA did not observe any items which could pose a danger to children (poisons, detergents, cleaning compounds, medications or hazardous items). There is drinking water dispenser available indoors for children in care. Children also bring their water bottles from home. The children's bathrooms are clean and sanitary. Children nap on mats if they choose to sleep, and bedding is stored individually and is taken home weekly to be washed by parents.Floors, equipment, and furniture were clean and were observed to be in good repair and free of sharp edges.

Food is prepared on site; breakfast, lunch and snacks are provided. During kitchen inspection, LPA observed a kitchen cabinet to have several cockroaches. LPA also observed a bottle of Raid on top of the fridge. Food is properly stored. Menus were posted where they could be reviewed by parents.

The facility has conducted an emergency drill within the past six months, last conducted on 08/07/2024. The facility has a working carbon monoxide detector and fire alarm. Facility met all posting requirement. The California Child Passenger Safety Law was posted by the entrance of the facility.

The outdoor activity space was inspected for compliance. The playground was enclosed by a fence at least four feet in height. LPA observed an AC unit and gas meter by the entrance of a classroom and is accessible to children in care. The surface of the outdoor activity space was well maintained. Drinking water in the outdoor activity space is by sports bottles with the child’s name on it. The outdoor equipment and toys were in good repair and free of sharp edges. There are no bodies of water present at the facility.

Staff files were reviewed for staff present during the facility inspection this date; 2 staff files were reviewed. Health screening and immunizations as required were reviewed. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a childcare center if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for 2 staff were reviewed and within compliance. During record review, LPA observed the assistant alone caring for 4 children. Director later arrived at the facility at 10 AM. After LPA file review, LPA observed assistant is not a fully qualified teacher.

Beginning March 31, 2018, H&S Code 1596.8662 requires all directors and employees to complete mandated reporting training, and to renew the training every two years. 2 staff had Mandated Reporter Training were completed and none were expired. During record review, LPA observed staff present did not have a valid EMSA approved Pediatric CPR/First Aid certifications.

Children's records were reviewed, and there was a separate, complete and current record for each child. A random sample of 5 children's files were reviewed for documentation of the child’s name, address, and telephone number of the child’s authorized representative and of relatives or others that can assume responsibility for the child if the authorized representative cannot be reached when necessary (LIC 700) and a medical assessment. Sign in/out procedure was reviewed for compliance. The person who signs the child in and out uses their full legal signature and records the time of the day.

Assembly Bill (AB) 2370, Chapter 676, Statutes of 2018, requires all licensed Child Care Centers (CCCs) constructed before January 1, 2010, to test their water (used for drinking and food preparation) for lead contamination before January 1, 2023, and then every 5-years after the date of the first test.

For child care center licenses issued after July 1, 2022, the licensee shall test their water for lead within 180 days of licensure pursuant to Written Directives section 101700 (PIN 21-21.1-CCP).

During interview with Director, Director stated the facility does not have drinking water fountains and they do not use the kitchen sink for food preparation. LPA observed Licensee has not submitted a letter of attestation to the department to not be required to complete a lead testing.

Therefore, in the areas that were inspected, 6 Type B deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit. Buildings and Grounds 101238(a)(1), Outdoor Activity Space 101238.2(h), Personnel Requirements 101216(f), Teacher Aide Qualification and Duties 101216.2(e), Food Service 101227(a)(16) and HSC-Lead Testing 1597.16(a)(1). See attached LIC 809D.

Incidental Medical Services (IMS) policy was discussed. For IMS information see Evaluator Manual - Regulation Interpretations and Procedures for Child Care Centers Sections 101173 and 101226. When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department. Information on the additional nutrition training, immunization requirements for children, and Health Schools Act (http://www.cdpr.ca.gov/docs/pestmgt/schoolipm.htm) were provided. The director was informed, and website given, about the California Child Care Disaster Planhas been posted to the UCSF California Childcare Health Program website: cchp.ucsf.edu/content/disaster-preparedness Also provided was information about the E-Learning Modules available at https://ccld.childcarevideos.org A copy of the California Department of Social Services Lead Information Brochure was explained and provided to the facility representative.

Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
