representative but they got distracted by something else. S1 stated they had not been notified of an incident of C1 was hit by a basketball on the head accidentally and another incident of falling back on the head on that day. S3 wrote and incident report for the fall but did not report the incident to S1.
LPA also interviewed 8 children including C1. C1 stated that they were in the basketball court, and they were trying to throw a ball. Another child had the ball already and C1 tried to grab it. C1 stated they tried to get C1 off. C1 held on tight to the ball that another child was holding. Someone (unknown) pushed C1 and C1 fell backwards on the head. C1 stated when C1 fell, everyone helped C1. C1 stated only S3 put ice pack on the back of their head. C1 could not mention any other staffs' names. C1 stated C1 was so tired. C1 used their jacket to try to sleep in the basketball court. Other children did not acknowledge observing any incidents. C3 stated they observed C1 laying on the floor in the Members Activity Room. Children stated the staff supervise them. The duration of C1’s sleeping is not exactly determined. However, it is confirmed that C1 has been sleeping in the basketball court here and there and in the Members Activity Room for 20 minutes.
During the course of interviews with 11 staff, 8 children, and 10 parents of whom one parent responded with no concerns, it was determined the preponderance of evidence standard have been met, the allegations of "Lack of supervision resulting in daycare children engaging in an altercation”, "staff did not seek medical attention for daycare child", and "staff did not provide daycare child with appropriate sleeping accommodations" are found to be SUBSTANTIATED. California Title 22 Regulations Section 101229, 101226(a), and 101226(1) are cited on 9099D next page. The director, Susana Delgadillo was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Notice of Site Visit must be posted on or adjacent to the door. Failure to post will result in Civil Penalties of $100.00. LPA Malek informed the director, Susana Delgadillo that this report dated 9/9/2024 documents type A citation shall be posted for 30 consecutive days as there is immediate risks to the health, safety, or personal rights of children in care. Also, LPA Malek informed the director, Susana Delgadillo to provide a copy of this licensing report dated 9/9/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification. The director, Susana Delgadillo, was provided with a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. The exit interview was conducted with director, Susana Delgadillo.
