Licensing Program Analysts (LPA) Giselle Lucero conducted a complaint investigation visit regarding the above complaint allegations. Upon arrival there were no school age children present at the facility.

A review of facility Personnel Report Summary on this date indicates that facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Department received a complaint on 01/15/2025 alleging (1) staff handled day care child in a rough manner and (2) staff yelled at day care child. Reporting Party (RP) reported Staff #1 (S1) picked up child #1 (C1) by their shirt and yelled in C1’s face due to C1 refusing to clean up.

During the complaint investigation, LPA Giselle Lucero interviewed 3 staff, 3 parents, 10 children, and obtained copies of the Child Protective Services (CPS) report, police report, and video footage.

On 01/14/2025, Director Roxanne Hernandez called the Orange Regional Office to report an unusual incident that occurred on 01/13/2025. Director reported Parent #1 (P1) informed the facility at 8:58 am that C1 and Child #2 (C2) would not be attending due to the children getting picked up by their aunt. At 5:35 PM, P1 arrived at the facility with 2 other unidentified adults and ask to speak with S1 outside the classroom. P1 asked S1 why S1 choked C1. One of the unidentified adults (Adult #1) accompanied with P1 who P1 claimed to be C1 and C2’s family member, started cursing to S1 in front of the children and staff present. Director reported P1 and A1 got aggressive. Staff #2 (S2) who was also present tried to calm down the situation. A1 then told S2 they were going to slap them in the face for trying to calm them down. S1 turned to return inside the classroom and A1 then hit S1 on the shoulder. Director stated the police were called to report the incident. Director also provided video footage of the incident.

LPA obtained and reviewed a copy of the police report from the Anaheim Police Department (APD). On 01/13/2025, APD Officer Lee and ADP Officer Dorantes spoke with P1. P1 informed officers that C1 expressed that they did not want to go to the facility because S1 had grabbed C1 by their shirt and lifted them off the ground. Officers spoke with C1, C1 stated on either 01/09/2025 or 01/10/2025 before lunch, S1 asked C1 and the other children in the classroom to clean up. While C1 was cleaning up, S1 told C1 to stop and to come over, C1 walked over to S1 and when C1 was within 1 foot away from S1, S1 grabbed C1 by the front of their shirt with 1 hand and lifted C1 off the ground. S1 than shouted at C1 to clean up before putting C1 back down on the ground. APD Officer Lee stated C1 was not physically injured and no visible marks were observed. Officer Lee called Child Protective Service (CPS) to report the incident and reported it to Senior Social Worker Ryan Fields.

On 03/10/2025, Investigator Cristian Lara obtained the CPS report. CPS report states, "It was reported an incident occurred last week at the child's preschool, Little Blessings located at 1026 South East St. Anaheim CA 92805. Per RP, the child's teacher was at school approximately on 01/09/2025 or 01/10/2025 and the
teacher asked everyone to clean up. According to child, they were cleaning and the teacher asked the child to come over to where the teacher was so the child approached the teacher. Thereafter, the teacher picked the child up by the shirt with one hand. The child was not injured during this incident and no marks, bruises or reported lasting pain was sustained during this incident." CPS report was determined to not meet the State requirements for intervention.

On 01/29/2025, LPA interviewed C1 and Child #2 (C2). C1 stated they were in their class and S1 told them to get closer and closer and picked them up. C1 stated they were lifted by the collar of their shirt. C1 stated their feet were touching the ground and denied their feet were lifted off the ground. C1 stated C2 observed the incident. C2 stated S1 instructed the children to clean up their toys and C1 was laying on the couch and staring at the other children clean and was not helping cleaning up. Then S1 told C1 to come closer, and observed S1 pick C1 up by their shirt and C1's legs weren't touching the ground.

On 01/24/2025, LPA Lucero interviewed 3 staff. During staff interviews, S1 denied allegations of lifting or yelling at C1. S2 and S3 stated they have never observed S1 lift C1 up by their shirt or yell at C1.

LPA attempted to interview 9 children, however only 8 children were qualified for interviews. Children interviewed stated they have never observed S1 lift a child up by their shirt. Children also stated S1 does not yell at children, but S1 speaks loudly to get the children's attention or to give directions. Children expressed no concerns regarding S1.

LPA interviewed 3 parents. Parents interviewed made no disclosure.

Based on the investigation conducted with 3 staff, 10 children, 3 parents, in addition to, Anaheim Police Department’s investigation, it was determined there was insufficient evidence that (1) staff handled day care child in a rough manner and (2) staff yelled at day care child. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated. Exit interview was conducted with Director Roxanne Hernandez. Notice of Site Visit was posted during the visit.
