C1 stated they were lifted by the collar of their shirt. C1 stated their feet were touching the ground and denied their feet were lifted off the ground. C1 stated C2 observed the incident. C2 stated S1 instructed the children to clean up their toys and C1 was laying on the couch and staring at the other children clean and was not helping cleaning up. Then S1 told C1 to come closer, and observed S1 pick C1 up by their shirt and C1's legs weren't touching the ground.

LPA attempted to interview 9 children, however only 8 children were qualified for interviews. Children interviewed stated they have never observed S1 lift a child up by their shirt. Children also stated S1 does not yell at children, but S1 speaks loudly to get the children's attention or to give directions. Children expressed no concerns regarding S1.
LPA interviewed 3 parents. Parents interviewed made no disclosure.
Based on the investigation conducted with 3 staff, 10 children, 3 parents, in addition to, Anaheim Police Department’s investigation, it was determined there was insufficient evidence that (1) staff handled day care child in a rough manner and (2) staff yelled at day care child. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegations are Unsubstantiated.
