Licensing Program Analyst (LPA) Corral conducted a Complaint Investigation to deliver findings regarding a Complaint that was received in our office on 09/20/2021. This complaint investigation was initiated on 09/27/2021. Prior to entering the Facility LPA Corral reviewed the COVID-19 Questionnaire with Teacher Cheryl Caldera. Upon entrance to the Facility there were 16 preschool children present with Cheryl Caldera and Preeti Saxena. Assistant Director Evelyn Rodriguez arrived to Facility at 8:30 AM.

Due to COVID 19 Guidelines, LPA Corral observed staff members wearing face masks, social distancing and following CDC and Dept of Public Health Guidelines. During the inspection it was determined the facility is operating within its licensed capacity and within staffing ratios. A review of the Facility Personnel Report Summary on 11/16/2021 indicates all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Complaint received in our office on 09/20/2021 stated the Facility is operating out of ratio. Reporting Party (RP) alleged that there were 3 napping children and 18 children awake with one Staff providing care and supervision. Five Staff interviews were conducted regarding the allegation, the Five Staff interviewed stated they are not left alone with more than 12 children. LPA Corral reviewed sign in/sign out sheets for the preschool children for the Month of September and no Ratio issues were discovered.

The Complaint received also stated a Teacher (S2) left children unattended in a classroom. The Reporting Party (RP) alleged that S2 left about 9 children unsupervised in Room # 3 for about 20 minutes. RP stated S2 was observed in the hallway talking to S5. When LPA Corral questioned S2 and S5 about leaving children unattended they both stated children are not left unattended, S2 and S5 both stated children are not left without supervision. The RP alleged that Facility staff do not provide a safe and comfortable environment. RP stated there was a milk spill in Classroom #3. RP alleged that S2 and S3 did not attend to a milk spill and were talking when there was a milk spill and the children were napping. When S2 was asked who cleans when there is a spill, S2 stated she or another Staff cleans it, S2 stated it gets cleaned. When S3 was asked who cleans up after snack and lunch, S3 stated she cleans it, S3 was asked when it gets cleaned S3 stated she cleans it when she sees it.

During the Initial 10 Day investigation on 09/27/2021, LPA Corral interviewed Assistant Director Evelyn Rodriguez and 4 Staff Members. All Staff interviews stated they are not left alone with more than 12 children. Staff also stated they do not leave children unattended. All Staff stated they clean up after snack/lunch time. When staff was asked what happens when there is a spill, all 4 staff stated spills are cleaned by the teacher in charge. Parent interviews were also conducted throughout the investigation, 8 parents were called 4 parents were interviewed, no disclosures or parent concerns regarding the above allegations. On 11/17/2021 LPA Corral conducted 6 Children interviews regarding the above allegations and no disclosures were made.

The allegation stating the Facility is operating out of ratio was investigated. Based on LPA Corral Record Review and Staff and Children interviews there is not enough evidence to substantiate the allegation, therefore, the allegation is found to be Unsubstantiated. This agency has investigated the complaint alleging Facility is operating out of ratio and although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated.

The allegation stating a Teacher left children unattended in classroom was investigated. Based on LPA Corral Staff and Children interviews there is not enough evidence to substantiate the allegation, therefore, the allegation is found to be Unsubstantiated. The Allegation stating the Facility staff do not provide a safe and comfortable environment was also investigated. Based on LPA Corral Staff and Children interviews, there is not enough evidence to substantiate the allegation, therefore, the allegation is found to be Unsubstantiated. This agency has investigated the complaint alleging the Facility does not provide a safe and comfortable environment and although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is Unsubstantiated.

During Record Review LPA Corral discovered the September 2021 Sign in/Sign out sheets for Classroom # 3 are not completed properly, the time of day for pick up and/or drop off were not included and parent’s or authorized representatives did not sign or include their full legal signature 36 times throughout the Month of September. The following citation is being cited during today’s inspection 101229.1 (a)(1) Sign In and Sign Out states, in addition to the sign-in procedure requirement of Section 101226.1(b), the licensee shall develop, maintain, and implement a written procedure to sign the child in/out of the childcare center that shall, at a minimum, include the following: The person who signs the child in/out shall use his/her full legal signature and shall record the time of day.

LPA Corral conducted an Exit Interview with Assistant Director Evelyn Rodriguez. The report was read reviewed and discussed with Assistant Director. Appeal Rights were explained, Assistant Director was provided a copy of Appeal Rights and signature on this form acknowledges receipt of these rights. Assistant Director was informed all appeals must be in writing and received by the Regional Office within 15 business days. Notice of Site Visit was provided and posted. Assistant Director was informed the Notice of Site Visit must be posted for 30 consecutive days and failure to post will result in a Civil Penalty of $100.00.
