RP stated they were encouraged to report their concerns to the Director or other agencies as necessary. RP reported Child #1 (C1) has stated comments in the past, such as, their teacher is sad, mean, angry and hit them. RP remembers C1 coming home with a red mark on their right hand sometime in February. RP was informed that C1 was having a difficult time during naptime and misbehaving. RP was also informed that C1 had been picked up aggressively from their mat after naptime by S1.
On 05/09/2023, LPA conducted an initial visit. During the visit, LPA was able to interview the Director and 2 staff members. LPA conducted classroom observation and attempted to interview C1, but they refused. LPA was also able to speak with the facility owner and the Area Manager. LPA made a second visit on 05/22/2023 interviewed 1 staff member. On 05/31/2023, LPA interviewed the last 2 staff members. LPA interviewed 6 children on 07/18/2023.
5 out of 5 staff members were able to provide LPA with examples of procedures when dealing with difficult behaviors such as redirection or notifying the Director. 5 out of 5 staff acknowledged being mandated reporter and its responsibilities. 3 out of 5 staff members stated they have not observed any form of maltreatment from staff toward the children. All staff interviewed denied hitting or rough handling Child #1.
During the course of LPA’s investigation, LPA was informed the facility conducted their own internal investigation in relation to the complaint allegations. The facility concluded the claims being made and all information gathered were determined to be gossip.
LPA interviewed 3 out of 5 parents. There were no disclosures made during the interviews. LPA interviewed 6 children and they did not provide any information pertaining to the claims of the complaint.
Based on LPA’s interviews conducted, the allegation 1) staff member hit daycare child 2) staff member handled daycare child in a rough manner may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is unsubstantiated.
Exit interview conducted and report was reviewed with Director Evelyn Rodriguez. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. A notice of site visit was given and must remain posted for 30 days.
