On 08/30/2024 Licensing Program Analysts (LPAs) Dianna Valdez Santana and Olivia Meza made an unannounced visit to Rainbow Rising- Cypress Village for the purpose to deliver findings of a complaint received. Upon arrival, LPAs were met by Director, Haley Rose. Director was explained the reason for today’s visit. LPAs were provided a tour of the facility; census was taken in the individual classroom. LPAs observed 2 Staff caring for 14 school-age children present at the time of inspection.
A review of the Facility Personnel Report Summary conducted on today’s date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 6/20/2024 a complaint was filed with the Licensing office stating, Staff did not properly supervise day care child during an outing. The reporting Party (RP) stated, Child #1 (C1) disclosed C1 fell into the water during the beach field trip on 6/19/2024. Another child fell on top of C1. Staff admitted allowing older peers to help watch the younger children since staff were occupied helping other children.

During the course of investigation, LPA interviewed 7 staff members, 5 parents and 5 children.

During the staff interviews, Staff 1 (S1), disclosed the following: The facility had a beach field trip on 6/19/2024 and it went well. The children had a good day. The water field trip ratio was 1:6. The staff coned off the area and placed a sign for their group, so children know where the staff at. Staff counted the kids every 15 minutes. At the beach, teachers in the water were facing the children and teachers spaced out throughout. It’s like the staff barricade/surround the students. The kindergarteners and young risers were only allowed to be in the water up to their ankles. The older children (high risers) were allowed to be in the water up to their waist. There was a yellow flag, so no one was allowed to go very far. S1 denied that staff ever asked the older children (high risers) to supervise the younger children. Staff 7 (S7) observed C1 fell in the water and S7 helped C1; another high riser also helped C1. During the conversation between S1 and C1’s parent, C1 disclosed to the parent that S7 was with C1 at the beach.

Staff 2 (S2) stated the following: the facility had a beach field trip on 6/19/24. C1’s family member told S2 that C1 had fallen into the water. S2 reminded the family member that the water ratio was 1:6. S2 told the family member that staff don’t let the children go in the water past their ankles. S2 shared that S7 saw C1 stumble into the water and helped C1 up. Then C1 fell into the water again and C1 got up with the help of an older child. S2 denied that staff ever put the high risers in charge of the younger children especially at the beach.

S7 stated the following: The facility had a beach field trip on 6/19/24. The supervision protocols during field trips was staff have to memorize the overall total and watched over their designated area. For the bathroom, staff take 6 kids at a time, same for water and for the ocean. Kids are in designated areas only. Staff ensure the safety of children by taking a head count, and triple check the head count. There are Rainbow Rising signs, so the kids know where the staff are at all times. The ratio for water activities is 1:6. All students must stay inside the coned areas. Staff do not ask the older children to supervise the younger students, but they do like to help the staff. C1’s family member shared with S2 that no teacher was watching C1 at the beach. S7 confirmed S7 was watching C1 at the beach. C1 was really cold in the beginning but later C1 went in the water because C1’s friends were in there. S7 held C1’s hand and another friend. S7 observed another child falling over C1. The older kid checked on C1 and S7 helped C1 up. C1 shared with S7 that C1 felt safe at the beach field trip.

LPA interviewed 5 children including C1 and the children did not make any disclosures. Child #1 (C1) disclosed the following: The beach day was fun, and it was a little scary because of the birds. C1 jumped into the water and fell. S7 and a high riser helped C1. S7 was watching C1 in the water.

Child 2 (C2) stated there were a lot of teachers on the beach day and they were watching all the kids, all the kids were safe. Child #3 (C3) stated the beach day was fun. S7, S4, S3 and S8 were in the water watching the children.

Child #4 (C4) stated at the beach field trip, the young risers were not with the high risers, they were behind the high risers; they are not allowed to go as deep. If they don’t know how to swim, they had to take steps back. The teachers don’t ask the high risers to help take care of the younger kids at the beach. The little ones did not fall a lot in the water because the water only went up to their ankles but sometimes the waves might have pulled them down a bit.

Child #5 (C5) stated at the beach, when C5 was in the water, it only went up to C5’s knees. C5 denied the younger kids were with the high risers. The young risers don’t go in the water, only the high risers.

LPA reviewed children and staff attendance sheet for the beach day and facility was well within ratio.

5 of 6 parents were interviewed, 5 of 5 parents interviewed had no issues or concerns with the daycare.

Based on LPA’s interviews and record review, there is insufficient evidence to corroborate the allegation of Staff did not properly supervise day care child during an outing. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegation is UNSUBSTANTIATED.

Exit interview was conducted, and report was reviewed and discussed. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights. End of Report.
