On 02/02/2024, Licensing Program Analyst (LPA) Romy Castanon made an unannounced visit to the facility for the purpose to deliver findings of a complaint that was received at the Orange County Regional Child Care Program Office. This is a continuation of the investigation initiated on 11/15/2023. LPA met with Director Nicole Carreon and explained the reason for today’s visit. A tour of four infant classrooms was conducted, and census was taken. Observed at the time of the visit was a total of 27 children and 10 staff members.
A review of the Facility Personnel Report Summary on 02/02/2024 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 11/09/2023, the Regional Office received a complaint report alleging 1) Child sustained unexplained injury while in care and 2) Staff did not inform child’s authorized person that child sustained injuries. Complaint states the morning of 10/20/2023, a bruise was found on each helix of Child #1’s (C1) ears. The complaint also states that the facility did not notify C1’s authorized representative of the injuries or to inquire the origin of the injuries. (Continue to page 2)

During the interview with Reporting Party (RP), they provided LPA with photos and videos that were taken of C1 during their morning drop off at the facility. RP stated they did not observe any ear injuries, and none could be observed in the photos. RP stated since C1 has attended the facility, they have received multiple incident reports but did not receive any on 10/20/2023. RP stated they never received a phone call from the facility and did not receive a note on the facility’s communication application. RP stated staff mentioned the injuries at the end of the day during pick up on 10/20/2023. RP states C1 no longer attends the facility. C1 was not interviewed due to age and language development.

During LPA’s initial visit on 11/09/2023, the Director and five staff were interviewed. Allegation 1) Child sustained unexplained injury while in care: 5 out of 5 staff were able to describe facility protocol when an unexplained injury is discovered. 5 out of 5 staff reiterated the morning process during daily health checks. 5 out of 5 staff were able to describe the responsibilities of being a mandated reporter.

LPA audited the daily reports and daily health checks for C1 for the month of October 2023. LPA did not see any comments entered by RP or by staff on the daily reports that could be found on the communication application. There was a total of eight additional entries during daily health checks by staff members such as rashes or scratches.

During interviews regarding allegation 2) Staff did not inform child’s authorized person that child sustained injuries, 5 out of 5 staff provided protocols of facility communication with parents. 2 out of 5 staff stated they followed the contact procedure but were informed that the facility was unable to get in contact with RP. 1 out of 5 stated they spoke with RP directly during pick up on 10/20/2023 and informed them the facility attempted to contact them regarding C1’s ear bruising.

LPA interviewed a total of 2 out of 5 parents who were contacted. There were no disclosures made by parents regarding the allegations of this complaint.

Children were not interviewed due to their age and lack of verbal skills.

Based on LPA’s interviews and record review, the allegations 1) Child sustained unexplained injury while in care and 2) Staff did not inform child’s authorized person that child sustained injuries it was determined there was insufficient evidence that child sustained unexplained injury while in care and staff did not inform child’s authorized person. Although the allegations may have happened or valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation is unsubstantiated.

Exit interview was conducted with Director Nicole Carreon. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. The Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. (End of Report)
