On 9/29/2025, Licensing Program Analyst (LPA) Vivian Trinh conducted an unannounced initial investigation at the facility regarding the allegation list above. LPA Trinh met with director Sofia Valdivia, who led LPA on a tour of the facility. At the time of the investigation, LPA observed 15 infants with seven (7) staff members in the Infant playground, and 15 toddlers with six (6) staff members in the Toddler playground.
A review of staff criminal clearance records on this date, 9/29/25, indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 9/25/25, a complaint was filed with the Department alleging that Staff do not keep the facility free of insects or pests. During the investigation, LPA Trinh conducted a physical plant inspection and interviewed four (4) staff members. LPA did not interview the infants and toddlers due to the children are too young and non-verbal. LPA Trinh also obtained pertinent documents. Continued Page 2.

The Director stated they will provide a written preventative maintenance plan, remove the caterpillar remains from the outdoor toddler playground, and send documents to the department by 11/14/25. Director stated that it will encourage children to play opposite areas, with more activities. The playground structure, block area, and the steep stools will be sweep down, and designated one teacher around that area for redirecting the children.

Based on observations and interviews with 4 staff members, LPA observed staff took the toddlers out to play in the Toddler playground where multiple caterpillars were observed crawling on the play structure, block area, couch and all over the ground. All four interviewed staff also admitted that they have seen multiple caterpillars in the Toddler playground, which poses protetial Health, Safety or Personal Rights risk to persons in care.

During the physical plant inspection today, 9/29/25, around 9:00am. LPA observed and obtained pictures showing multiple larva bugs/caterpillars on the children’s play structure, block area, couch and all over on the ground in the Toddler playground. The Director asked the staff members to remove all the bugs/caterpillars as LPA pointed out to the Director during the visit.

During the staff interviews, all four (4) staff members admitted the facility has larva bugs/caterpillars on the Toddler playground. All four staff members interviewed stated that they have observed caterpillars since 09/25/25 and notified the Director. The Director has informed the management and submitted a work order for the exterminator to address the issue. All four staff members mentioned that it is during this season, after the staff cleaned up in the morning around 7:45 a.m., when they took the children to the playground at 9:00 a.m., and the caterpillars were all over the playground again. LPA obtained pictures of the situation. At 11:45am, LPA inspected the Toddler playground once again and recorded a video clip showing multiple larva bugs/caterpillars on the children’s play structure, block area, couch and all over the playground, after the staff had already cleaned and removed the caterpillars that were seen at 9:00am.

Based on the information gathered from LPA's observations and interviews, the preponderance of evidence standard has been met; therefore, the allegation Staff do not keep the facility free of insects or pests found to be SUBSTANTIATED. California Code of Regulations, Title 22 Buildings and Grounds 101238 (a)(1) was cited on the attached LIC 9099D

An exit interview was conducted with the Director Sofia Valdivia. Notice of Site Visit was posted during the visit. Director was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights.
