32 | During the course of investigation, LPA interviewed 7 staff members, 3 parents and 0 children. Children were not interviewed due to being nonverbal.
During the staff interviews, seven (7) out of seven (7) denied ever yelling at children. Seven (7) out of seven (7) staff denied witnessing any staff members yelling at children. Staff #1 (S1) stated when staff are having fun outside, they may be louder but in the classroom they speak softer. S1 indicated that S1 has never had to speak to anyone about being too loud. S1 stated staff get reminders about how to speak to children at their annual meeting with all the sites. Staff #2 (S2) stated that staff may use “mom” voice to get their attention. S2 stated S2 speaks loudly naturally but denied speaking to children in a rough harsh tone. Staff #3 (S3) stated normally S3 speaks softer but with the children S3 is more energetic, would say S3’s voice level is moderate. Staff #4 (S4) stated that staff are not allowed to yell and must use low voices. S4 stated that S4 acknowledged occasionally projecting their voice to gain attention but not yelling. S4 stated that S4 sing songs and claps to get their attention. Staff #5 (S5) stated that S5 speaks in a normal tone when speaking with children. S5 disclosed observing Staff #6 (S6) has a little bit of a strict but not inappropriate tone, twice when speaking with children but does not yell. S6 is mainly with older children that are more active and louder so S6 is probably used to being louder because of them. Once S6 has used the word “stop” in strict tone with a child, so S5 picked up the crying child and calmed the child. Another time it was when 2 children were fighting over a toy, and S6 took the toy away and said, “Give me, no more”. S5 walked over and redirected the child to another toy. S5 states S6 is a loud person sometimes but has caught S6’s self and has toned it down. Staff #6 (S6) stated that staff can be stern when talking to children. S6 disclosed being naturally loud when speaking but denied yelling at children and has not seen any staff yell at children in care. Staff #7 (S7) stated S7 has projected S7’s voice but not yell and not harsh. Three (3) of three (3) parents interviewed had no issues or concerns with the daycare. While conducting inspections at the facility, LPA did not observe staff to speak inappropriately to children in care, LPA did not observe yelling or inappropriate tones.
Based on LPA’s interviews and record review, there is insufficient evidence to corroborate the allegation of Staff yells at daycare children. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur; therefore, the allegation is UNSUBSTANTIATED.
