On 9/05/2024 at 2:00 PM, Licensing Program Analyst (LPA), Karen Navar conducted an unannounced complaint inspection for the purpose of delivering findings. This is a continuation of a complaint inspection initiated on 06/25/2024.

Upon arrival LPA met with Director Flora Amini and was led on a tour of the facility. At 2:05PM, LPA observed a total of 28 preschoolers and 4 staff.

A review of the Facility Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
During today’s inspection the facility was operating within its licensed capacity and within compliance of staffing ratios. Continue to page 2

During interviews with 8 staff, staff stated they witnessed or heard Staff 1 (S1) and Staff 5 (S5) engaging in a verbal altercation in the presence of day-care children which poses a potential health, safety, or personal rights to children in care. In a separate interview, Staff 6 (S6) stated they felt nervous, and that staff had to intervene to stop the altercation. Staff interviewed stated they have been left out of ratio themselves and have witnessed other staff being out of ratio which poses a potential health, safety, or personal rights to persons in care.
Based on LPA observations and interviews with reporting party, staff, parents, and children, the preponderance of evidence has been met; therefore, Physical Plant: Staff did not meet napping equipment requirements, Qualifications: Facility doesn’t have a qualified director on the premises, Ratio: Facility is operating out of ratio, Personal Rights: Staff engaged in verbal altercation in the presence of day-care children are substantiated; see LIC9099D for deficiencies cited.

Exit interview conducted and report was reviewed with Director Flora Amini . The Director was informed that the “Notice of Site Visit” must be posted on or adjacent to the door for 30 days. Failure to post will result in a Civil Penalty of a $100.00. Appeal Rights and deficiencies were discussed. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

On 06/25/2024, the Orange County Child Care Office received a complaint alleging: 1) facility doesn’t have a qualified director on the premises, 2) facility is operating out of ratio, 3) staff engaged in verbal altercation in the presence of day-care children, and 4) staff did not meet napping equipment requirements.

During the investigation, LPA toured the facility, obtained Parent Handbook, LIC500 Personnel Report, Parent Roster, sign in and out sheets, took photos, and conducted interviews with the Reporting Party, staff, parents, and children.

LPA conducted 3 visits on 7/01/2024, 8/02/2024, 8/22/2024 and a director was not present on all three visits. LPA was informed by staff that the facility has no director which poses a potential health, safety, or personal rights to persons in care.

On 07/01/2024 at 9:15AM, LPA conducted an inspection for the purpose of investigating a complaint received on 6/25/2024 in the Orange County Child Care Office and toured facility with Teacher-Flora Amini, then met with Facility Administrator Joshua Arnaldo (Josh). During inspection LPA toured classrooms and observed ripped napping mats in toddler classroom which poses a potential health, safety, or personal rights to persons in care. On this date LPA interviewed staff and reviewed staff files.

On 08/02/2024 at 12:45PM, LPA conducted an inspection for the purpose of napping ratios and to interview children. LPA met with Teacher Flora Amini then met with Facility Representative Josh Arnaldo. Staff were supervising children and children were resting on mats with blankets and sheets.

On 8/21/2024, LPA conducted parent interviews. LPA called 8 parents and 1 of the parents called were able to be interviewed. Parent interviewed did not disclose any information pertaining to the allegations.

On 08/22/2024 at 4:30PM, LPA conducted an inspection for the purpose of observing afternoon ratio. LPA observed 2 staff and 12 children on the playground. LPA requested sign in and out sheets for children.

Children interviewed did not divulge any information that pertained to the allegations.

On 06/25/2024, the Orange County Child Care Office received a complaint alleging: 1) Uncleared adult, 2) broken toys are being used for day-care children, and 3) unqualified staff on the premises.

During the investigation, LPA toured the facility, obtained Parent Handbook, LIC500 Personnel Report, Parent Roster, sign in and Out Sheets, took photos, and conducted interviews with the Reporting Party, 8 staff, and 3 children. LPA called 8 parents for interview and 1 parent interviewed.

On 7/01/2022, 8/02/2024, 8/22/2024 LPA conducted inspections regarding a complaint received in the Orange County Child Care office on 6/25/2024. During inspections a review of staff records on those dates indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 7/01/2024 at 9:15AM, LPA Navar toured the facility with Teacher Flora Amini. During tour Teacher Flora and LPA observed toddler playground and preschool playground. Toys appeared to be intact, functioning, and free of sharp edges. 2 staff interviews conducted stated they throw away broken toys. 6 staff stated they let the administration or owners know if materials need to be replaced. LPA reviewed staff files for all staff present and did not observe any staff records indicating there is an unqualified staff on this date.

On 8/21/2024, LPA conducted parent interviews. LPA called 8 parents and 1 of the parents called were able to be interviewed. Parent interviewed did not disclose any information pertaining to the allegations.

On 8/22/2024 at 12:45PM, LPA interviewed 3 qualified children. All 3 children interviewed did not reveal any information pertaining to the allegations.

Based on LPA observations, interviews with reporting party, staff, children and parents, there was not enough evidence to substantiate the allegations Criminal Record Clearance: Uncleared Adult, Qualifications: Unqualified Staff on the premises, Physical Environment: Broken Toys are being used for daycare children. Although the allegations may have happened or is valid the preponderance of evidence has not been met; therefore, the allegations are found to be UNSUBSTANTIATED. No deficiency cited.
