LPA reviewed staff timesheets and was able to verify the dates referred were 07/24/2023-07/28/2023, Staff #2 was on vacation that week. Complaint also mentioned the Director Christina Rotenberry includes herself in ratio but does not physically go to the classroom to assist the staff. LPA called Reporting Party (RP) on 08/23/2023 and left message for further details but did not receive a call back.
S1 is a Primary Floater that assists with breaks or lunches in Room 2 and Room 5. During the interview with S1, they stated they enrolled in school after being hired by the facility but have never been left alone to care for the children. S1 states they are always accompanied by a qualified teacher. There are 2 qualified staff assigned in Room #2 and 3 qualified teachers in Room #5. During LPA’s initial visit on 08/29/2023, LPA interviewed the Director and 7 staff members. During staff interviews, all 7 staff stated they have not observed any staff, whether qualified or not, being left on their own to care for children.
LPA reviewed staff records and determined that the school has 9 out of 13 qualified teachers. LPA reviewed timesheets, as well as children attendance for the week of 07/24/2023-07/28/2023. LPA reviewed the schedules of staff and number of children in care after 4:00pm. On 07/24/2023, there were 24 children, 2 assistants and 3 qualified staff. On 07/25/2023, there were 29 children, 2 assistants and 3 qualified staff. On 07/26/2023, there were 25 children, 2 assistants and 4 qualified staff. On 07/27/2023, there were 33 children, 2 assistants and 3 qualified staff. On 07/28/2023, there were 23 children, 2 assistants and 2 qualified staff. S1 ended their day between 4:59pm-5:33pm, every day during the week of 07/24/2023-07/28/2023. LPA determined the facility had scheduled at least 1 qualified staff to stay after 5:00pm that did not include upper management who are also qualified and close at 6:00pm. Since LPA’s initial visit, the facility has continued to hire staff and utilize substitute staffing agencies.
LPA interviewed 7 out of 7 staff asking if the Director is needed to be in ratio, what is the Director role. All 7 staff stated if the Director is needed for coverage in the classroom, the Director makes herself available and stays in the classroom as long as necessary. LPA interviewed Director who stated that if she is needed in the classroom, she stays in the classroom until the staff arrive. Director stated in the morning, they are responsible for children attendance check in’s and have a sign directing parents where to drop off if they are in a classroom. Director follows the facility’s daily schedules and will provide coverage for staff breaks. Director states they are also available via walkie-talkie in the event coverage is needed outside scheduled break times. (Continue to page 3)
