25 | An unannounced case management inspection was conducted on this date by Licensing Program Analyst (LPA) Dean Valencia. Present during today’s inspection was Ayanthi Ratnayake. At 10:20am, LPA conducted a tour of the facility, and observed a total of 100 children with 14 staff. A review of adult records indicates that all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 7/27/2021 Complaint was filed with the Department to report an incident that occurred on 7/16/2021. A child #1 was served cheese and a cheese cracker; a food item that the facility was aware that child #1 was allergic to and prescribed an epinephrine pen. On 11/09/2021 the investigation into the complaint was Substantiated due to C1 obtaining serious bodily injury in the childcare, in having a serious allergic reaction to a food item served. The facility was cited California Code of Regulations, Title 22, Division 12, Chapter 1, Section 101226(b), 101226(c), 101226(e)(3)(a), and 101223(a)(2).
On today’s date Facility is being given an Enhanced Civil Penalty. Under Health and Safety Code, section 1596.99 applicable to Child Care Centers, for a violation that the department determines resulted in serious injury to a child in care, the department shall assess enhanced civil penalty in the amount of $10,000 for a Child Care Center of capacity 101 or more. A serious injury involving a child needing to be hospitalized due to allergic reaction meets the definition of a serious injury under the statute. An ECP assessment in the amount of $10,000 is therefore supported by the facts. Exit interview was conducted with Facility director. Notice of Site Visit was posted during the inspection. Facility representative was informed that the notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. Facility representatives was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First level appeals should be sent to the regional manager to the address listed above.
