Licensing Program Analyst (LPA) Tran conducted an unannounced complaint inspection to deliver the findings for the above allegation. This is a continuation of the investigation initiated on 09/27/23. At 12:45pm, LPA Tran met with Director Krista Bartolome, who guided LPA on tour of the facility. Census was taken and observed were 61 children and 10 staff members including 8 toddlers with 2 staff members in Juniper classroom, 10 toddlers and 2 staff members in Elm classroom, 12 preschool children with 2 staff members in Birch classroom, 15 preschool children and 2 staff members in Spruce classroom, and 16 children and 2 staff members in Camellia classroom.

A review of the Facility Personnel Report Summary on 11/07/2023 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 09/27/2023, the Regional Office received a complaint with allegation alleging unqualified staff are providing care and supervision.

It was reported that facility has multiple staff that does not have any Early Childhood Education (ECE) units and Staff #1(S1), Staff #2 (S2) and Staff #3 (S3), who had no ECE, were counted in ratio to provide care and supervision for the children in the facility.

During investigation, LPA inspected the facility on 09/27/23 and on 11/07/2023, interviewed 8 staff and review record of 13 staff members in the preschool and toddler options license.

During the inspections on 09/27/23 and on 11/07/23, the facility was observed operating within compliance with staffing ratio.

All interviewed staff denied witnessing the facility operating out of ratio: 1 qualified staff to 12 preschool children in the preschool classrooms and 1 qualified staff to 6 toddlers in the toddler options classrooms. All interviewed staff denied that the identified unqualified staff S1, S2 and S3 were working alone with the children, and confirmed that S1, S2 and S3 worked with a fully qualified teacher in Camellia preschool classroom, Elm Toddler classroom and Juniper Toddler classroom daily

During record reviews, LPA reviewed transcripts of all 13 current staff members in the preschool and toddler options program. 8 out of 13 staff members are qualified teachers with 12 ECE units, 5 staff members have partial units and are enrolling in another ECE courses including S1, who has 6 ECE units and S2, who has 6 ECE units, S3 has no ECE unit and Staff #4 (S4) has 6 ECE units and Staff #5 (S5) has 9 ECE units). Although, S1, S2, S3, S4 and S5 did not have the ECE units to be considered as fully qualified teachers, S1, S2, S3, S4 and S5 were counted as teachers' aides and can be counted into ratio to provide supervision for the children in care under direct supervision of a fully qualified teacher. Facility schedule in the month of October 2023 revealed S1, S2, S3, S4, and S5 were scheduled to work with a fully qualified teacher daily and were working within compliance with ratio.

Based on the information gathered from LPA’s observations on 09/27/23 and on 11/07/2023, interviews conducted with 8 staffs, and record review of staff’s schedules and transcripts, there is insufficient evidence to corroborate the allegation unqualified staff are providing care and supervision. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove unqualified staff are providing care and supervision, did or did not occur, therefore the allegation is unsubstantiated.

Appeal Rights were explained. The Director was provided a copy of appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. A Notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Krista Bartolome.
