On 09/29/2023, the Regional Office received a complaint with allegations alleging (1) Staff member pushed a day care child and (2) Staff member yells at day care children.
During investigation, LPA interviewed 5 staff on 10/03/23 and 11/07/23. LPA attempted to interview 10 parents, 2 out 10 parents responded and provided feedback. LPA also attempted to interview 5 children, 4 out of 5 children qualified for the interview and provided responses.
All interviewed staff denied witnessing any staff push or yell at the children. Interviewed staff gave consistent responses regarding facility's discipline procedure including giving redirection, allowing child time to calm down or to express their feelings, then talk to child to encourage positive behaviors. Interviewed parents did not share any concern related to the allegation. Interviewed children denied witnessing any teacher pushing or yelling at any child.
Based on the information gathered from LPA’s interviews with 5 staff, 2 parents and 4 children on 09/27/23 and on 11/07/2023, there is insufficient evidence to corroborate the allegations (1) Staff member pushed a day care child and (2) Staff member yells at day care children. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove (1) Staff member pushed a day care child and (2) Staff member yells at daycare children, did or did not occur, therefore the allegations (1) Staff member pushed a day care child and (2) Staff member yells at daycare children are unsubstantiated.
Appeal Rights were explained. The Director was provided a copy of appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above. A Notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Krista Bartolome.
