Reporting Party (RP) alleges facility staff do not properly supervise children at all times. RP mentioned on May 02, 2024 they observed three children enter the restroom without any supervision while two staff were present inside the classroom.
On 5/17/2024 LPA received two videos of the allege incident and one picture from the RP. Videos and picture received do not show the entire classroom and LPA was only able to observed one staff present. LPA couldn't determine from the videos or picture received, where the second staff was positioned.
On 5/21/2024, LPA interviewed three staff. All staff interviewed stated when children enter the restroom, staff are suppose to stand near the door to have visual observation.
On 5/21/2024 LPA retrieved the child care facility roster and contacted 13 parents via phone call. Out of the 13 parents called three parents were able to be interviewed. Parents interviewed did not divulge any information pertaining to the allegation.
Based LPA observation, interviews with staff and parents, there was not enough evidence to substantiate the allegation.
The Orange County Child Care Office has investigated the complaint alleging facility staff do not properly supervise children at all times: although the allegation may have happened or are valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.
In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit.
Exit interview conducted and report was reviewed with Director Krista Bartolome. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.
Appeal Rights discussed. Director was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. |
