On 11/16/2021, Licensing Program Analyst (LPA) Tran conducted an in person inspection to deliver the findings regarding the above complaint allegations. LPA Tran met with Director Angelica Burgos. The Covid-19 Emergency Response questionnaires were asked. A toured the facility was conducted, and a census was taken. Observed at the time of the visit was a total of 7 preschool children with 1 staff in one classroom, 7 preschool children with one staff on the playground, and 8 school age children with 1 staff in another classroom. A review of staff criminal clearance records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 09/15/2021, the office received a complaint alleging, staff left children unattended, staff did not prevent an altercation between children, and staff yelled at child. Reporting Party (RP) disclosed there was a birthday party going on at the facility and childcare staff stepped out of the room leaving the children alone in the classroom. While the teachers were outside of the classroom a child “smacked” child #1 (C1). RP reported that when the staff returned, they saw C1 crying and separated the children. RP was unable to provide details regarding how staff yelled at children. (Continue next page)

During the investigation, Licensing Program Analyst (LPA) interviewed three staff members, six parents, five children, reviewed facility roster, children, and staff files.

On 09/23/2021, LPA Tran and Licensing Program manager (LPM) Ho conducted an initial 10-day inspection and toured the entire facility. During the tour, LPM Ho and LPA Tran observed 10 preschool children in 2 classrooms with two staff members.

During the staff interview, all three interviewed staff denied witnessing any staff member yelling at children or witnessing any children fighting with each other. Staff #2 (S2) disclosed that there was an incident occurred during a child birthday party when C1 and C2 were playing fighting with each other and C1 cried. S2 separated C1 from C2 and asked the director to talk to C1 and C2 separately. S2 also disclosed S2 did not witness C1 and C2 hitting each other but witnessed C1 and C2 taking each other plates. S2 also disclosed C1 and C2 were sitting right next to S2 so S2 was able to stop any fighting if there was any. Director talked to C1’s parent about the incident when the parent arrived to pick up C1. All interviewed staff confirmed that children are always being supervised by staff during the birthday party. No staff left the children unattended to go to the kitchen during the birthday party. All interviewed staff also stated if children needed to use the restroom, staff will communicate with one another so supervision can be provided.
LPA learned that to discipline children, staff will give verbal redirections, give children time to think about their behaviors and will talk to them to about their behaviors. Staff will also contact parents to discuss how to best resolve the issue.

All five interviewed children stated they did not witness any children fighting with each other. Three of five children stated the children only play fighting with each other.
Three of five interviewed children stated there was always one staff supervising children. If staff needs to step away, another staff will come to supervise. One child doesn’t remember which teachers were in the kitchen and which teachers were in the classroom during the birthday party. C1 stated C1 remembered crying in a birthday party but did not get hurt. C1 stated C1 did not fight with any one at the facility or witnessing any children fighting with each other. C1 disclosed when C1 cried on the birthday party day, the teacher was in the kitchen.
All five interviewed children did not witness any staff member yelling at children at the facility.

LPA Tran contacted five parents by phone and was able to interview five parents. All five interviewed parents stated their children are happy and like to go the facility. Four of five interviewed parents also stated they did not have any concern or issue with the facility. One parent shared concerns not related to the allegations.

Based on the information gathered from LPA's interviews, observation, and reviewing records, there is insufficient evidence to corroborate the allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged staff left children unattended, staff did not prevent an altercation between children, and staff yelled at child, did or did not occur, therefore the allegations are UNSUBSTANTIATED.

Exit interview was conducted. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. This report LIC 9099 and appeal rights were provided to the director. First level appeal is to Regional Manager, address is above on the report.
