During the course of investigation, LPA interviewed 3 staff members, 3 parents and 4 children.

Regarding the allegation, Staff roughly handled a child, three (3) out of three (3) staff denied violating any child’s personal rights. Staff #1 (S1) stated S1 or any other staff have not violated any child’s personal rights. S1 stated they have children like Child #1 (C1) that have challenging behavior so sometimes staff need to come around C1 to stop C1 from hurting C1’s self. S1 denied ever observing Staff #2 (S2) be rough with C1 or the other children or ever observe S2 mock C1. S1 stated the staff deal with challenging behaviors by talking about strategies with each other, like for instance C1 tends to elope so staff try to help C1 during transitions. S1 stated the staff model behavior first; staff also teach children sign language for children like C1 who have limited language. Staff redirect C1 often and if C1 is struggling and is throwing C1’s self on the floor staff give C1 some space. Staff #2 (S2) denied rough handling children or mocking any child. S2 stated the times S2 has heard C1 say “ayuda” (help) is during transitions, C1 will throw C1’s self on the floor and then C1 will ask for “ayuda” to get up and C1 will say “listo” (ready). S2 stated staff deal with challenging behaviors like C1, staff encourage C1, if C1 throws C1’s self on the ground staff try to give C1 some space. Staff encourage C1 to return when C1 is ready and C1 is ready C1 will say “listo”. Staff also use similar strategies that SDC uses like redirection, and use “first then” language. Staff #3 (S3) denied violating children’s rights and denied observing any staff violating a child’s rights. S3 stated staff deal with challenging behaviors by telling the child to “calm body” and then once they are calm, they can go back to playing. Additionally, staff model behavior first; staff also teach children sign language for children who have limited language. Staff redirect the children often. Four (4) out of four (4) children interviewed did not make any disclosures about the allegation. Three (3) of 3 (3) parents interviewed had no issues or concerns with the preschool.

Regarding the allegation, Staff locked child outside of the classroom. Two (2) out of three (3) staff denied a child was locked out of the classroom. One (1) out of the three (3) staff is not present during the afternoon session. Staff #1 (S1) denied that C1 was locked out of the classroom by S2. Staff #2 (S2) denied locking C1 out of the classroom in a mocking way. Staff #3 (S3) is not present when the alleged incident occurred. Four (4) out of four (4) children did not make any disclosures. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegations are UNSUBSTANTIATED.
