On 11/03/2022 Licensing Program Analyst (LPA) Stella Gutierrez made an unannounced visit to the facility for the purpose of a case management incident. LPA was met by Lisa Kathleen, Interim director who was explained the reason for todays visit. LPA observed 04 preschool staff and 27 preschool children during todays visit.
A review of the Facility Personnel Report Summary conducted on 11/03/2022 indicates all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
Lisa Kathleen was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The Orange County Regional Office Child Care Program received a complaint on 06/22/2022 regarding an incident that occurred at Guidepost Montessori at Las Flores in classroom #3 on 05/23/2022. The complaint investigation concluded with a substantiated finding on 08/19/2022. During the investigation previous director, Krista Bartolome and Staff #1 were interviewed on 06/22/2022 and 06/30/2022 regarding the incident. Director and Staff #1 stated that the child in question was left unattended in the restroom on 05/23/2022 for at least 4-5 minutes. Based on video footage reviewed by LPA on 06/22/2022 of the incident that occurred at the facility on 05/23/2022, it was revealed that the child in question was left unattended in the restroom in classroom #3 on 05/23/2022 by Staff #1.

Based on LPAs observations and interviews the following violation was observed and is being cited in accordance with California Code of Regulations, Title 22, Division 12, Chapter 1, Article 6 Section 101229 (a) (1) , is being cited on the attached LIC 809D. A civil penalty will be assessed today.

LPA Stella Gutierrez informed Interim director Lisa Kathleen that this report dated 11/03/2022 documents one Type A citation which shall be posted for 30 consecutive days as there is/are immediate risk to the health, safety, or personal rights of children in care. Also, LPA Stella Gutierrez informed the Lisa Kathleen to provide a copy of this licensing report dated 11/03/2022 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Exit interview conducted and report was reviewed with the Interim director Lisa Kathleen. Appeal Rights and deficiencies were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days.

A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100.

Lisa Kathleen, new Interim director has provide a care and supervision to staff within the last two months on previous substantiated finding on 08/19/2022. Director agrees to provide a memo to remind all staff of the importance of supervision and procedures for restroom use protocols at the facility.

This requirment was not met as evidence by review of video footage on 06/22/2022. Video footage revealed that on 05/23/2022 a child was left unattended in the restroom for at least 4-5 minutes. Statment by Staff #1 and previous director Krista Bartolome coincide that the incident did occur. This poses an immediate risk to the child duriing that time.
