On 08/19/2022 LPA, Gutierrez arrived at the facility for the purpose of a self reported incident that was received on 07/06/2022 from previous director, Krista Bartolome. LPA, Gutierrez was met by new interim director, Lisa Kathleen who was explained the reason for today's visit.

A review of the Facility Personnel Report Summary conducted on 08/19/2022 indicates all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The facility representative was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.
On 07/06/2022 it was self reported that a parent of a child that attends the facility contacted director, Krista Bartolomi on 07/06/2022 regarding an incident that took place at the facility a couple weeks prior. Date was unknown. Parent stated that he/she arrived to the facility to pick their child up and when arriving to the playground, the staff#1 who was providing supervision and care did not know where the child was. Director also reported that parent then stated to her that it was observed that another staff member (Staff #2) found the child by at the gate around the corner from the playground and brought the child back inside the facility.

LPA, Gutierrez observed side yard at the facility where the incident occurred. The side yard is gated with the potential for a child to exit which leads in to the parking lot of the facility and a busy street nearby walking distance. This poses an immediate risk to the children in care when the children when not 100 % supervised by the facility staff.

On 08/08/2022 LPA, Gutierrez conducted an interview with Staff #2. Staff stated that the child was observed alone at the side yard of the facility without supervision. Staff #1 is no longer working at the facility.
Based on interview statements and observation there will be a citation issued during today's visit.
Title 22 Division 12 Chapter 1 Article 6 Regulation code 101229 (a) (1) will be cited today.

LPA, Stella Gutierrez informed interim, Lisa Kathleen that this report dated 08/19/2022 document(s) 1 Type A citations which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care. Also, LPA, Stella Gutierrez informed the interim director to provide a copy of this licensing report dated 08/19/2022 that documents any Type A citations to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

An exit interview was conducted with Lisa Kathleen, interim director. This report was reviewed, and a copy provided. A notice of site visit was provided and must be posted for 30 days in a prominent area.

This need was not met as evidence by interview statements and observation. On an unknown date but self reported on 07/06/2022 it was stated a child was left unattended while at the facility. Interviews conducted coincide with the alleged allegation that a child was left unsupervised at a gated side yard at the facility. This poses an immediate risk.
