During the investigation, LPA conducted observations, interviewed three (3) staff members, including the Director, six (6) children, and five (5) parents, 1 out of 5 parents did not respond, and reviewed pertinent records, including LIC 500 Personnel Report, LIC 9040 Children’s Roster, the Personnel Handbook, child incident reports, child daily reports, and the Parent Handbook.
Regarding allegation a staff member violated the child's personal rights by inflicting physical pain. During the interview, three (3) interviewed staff members stated that they did not witness S3 inflicting physical pain on the children in care. LPA also interviewed six (6) children; all interviewed children reported that they neither witnessed nor experienced S3 disrespecting or inflicting pain on children in care. Four (4) interviewed parents did not raise any concerns regarding the above-mentioned allegation.
Based on the information gathered from LPA observations, interviews, and record reviews, there is insufficient evidence to corroborate the allegation that a staff member violated the child's personal rights by inflicting physical pain. Although the allegation may have happened or are valid, there is not a preponderance of evidence to prove the allegations did or did not occur in the day-care facility. Therefore, the listed allegation is UNSUBSTANTIATED.
An exit interview was completed. The report was reviewed and discussed with Director Julie Tran. Appeal Rights were provided. The Director was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
