The investigation consisted of; physical plant tour, interview with two staff including the Director, review of records.
The investigation revealed the following; On 10/29/21 before school opened a cabinet fell from the wall down to the floor in Toddler Mandarin classroom. Director reported there were no children in the facility at the time the incident occurred. However, the area where cabinet fell, is used by children during hours of operation. Per Director’s statement no one was injured.
LPA reviewed copy of timeline, proof that original cabinets were installed by a contractor. Director completed an Action Plan that included but not limited to; immediate removal and inspection of all cabinets by a contractor; scheduled a Townhall Meeting with all parents
Based on LPAs observations and interviews which were conducted record review(s), the preponderance of evidence standard has been met, therefore the above allegation is found to be substantiated. California Code of Regulations, Title 22, Division (12) and Chapter (1) are being cited on the attached LIC 9099D.
An exit interview was conducted with director. Appeal Rights were explained. The Director was provided a copy of appeal rights (LIC 9058) 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the Regional Manager to the address listed.
The Notice of Site Visit was given and discussed it must be posted as required by H & S Code Sec. 1596.817. Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.00
