On 06/20/2024 Licensing Program Analyst (LPA) Dianna Valdez Santana made an unannounced visit to Marco Polo Children’s School for the purpose to deliver findings of a complaint received. Upon arrival, LPA was met by Director, Kimberly Garcia. Director was explained the reason for today’s visit. LPA was provided a tour of the facility; census was taken in individual classrooms. LPA observed 23 Staff caring for 79 children present at the time of inspection.
A review of the Facility Personnel Report Summary conducted on today’s date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 4/23/2024 a complaint was filed with the Licensing office stating, Staff did not properly clean the day care after children’s illnesses. Reporting Party (RP) stated, “Hand, foot, and mouth disease running rampant in the English Toddler class (going back 6 weeks) with many children contracting it. The former director was notified by the teacher but decided not to inform any parents.

During the course of investigation, LPA interviewed 8 staff members, 5 parents and 5 children.

During the staff interviews, Staff 2 (S2), disclosed that the procedures for cleaning after there has been an illness is staff are supposed to sanitize the classroom, when the kids are not present, staff use bleach but if they are present staff cannot use bleach. Staff also clean the toys. S2 stated there was a Hand Foot and Mouth outbreak in S2’s class, there were at least 3-4 children that got it, this was in March. The children who contracted it were sent home and their parents were notified. The other parents were not notified because the previous director said she did not want to send parents into a panic. The other staff were not notified of it because previous director also said she did not want to send to send the school into a panic either. S2 does not think previous director reported the incident to Licensing or the Department of Health. Staff 3 (S3) said the procedures for cleaning after there has been an illness is If a child put a toy in their mouth, it has to be placed in a bin to be sanitized. There was a Hand Foot and Mouth outbreak in the toddler English classroom. S3 thinks they did sent the children home but, S3 didn’t know how many. The teacher told S3 about it. S3 was not aware if parents were told, at least not the parents in S3 class. S3 didn’t think all staff and parents notified about it. S3 is not aware if Licensing and the Health Department being notified of the outbreak. Staff 4 (S4) stated there was a Hand Foot and Mouth outbreak in one of the classrooms, not in S4's class but another class did. The infected children were sent home, but S4 doesn't know many, it was not any in S4's class. S4 doesn't think the other parents or Licensing were notified.

Staff 5 (S5) said the procedures for cleaning after there has been an illness is a chart that staff have to follow if there are a number of symptoms then we send the child home. Every day at the end of the day staff spray with the bleach solution. When asked if there was a Hand Foot and Mouth outbreak in one of the classrooms, S5 said not recently maybe last year, it was during break, the infected child wasn’t at the school but on vacation. S5 does not know of any other cases in other rooms. At least, staff, and other parents were not told of an outbreak. S5 did not know if Licensing was informed. Staff 6 (S6) the procedures for cleaning after there has been an illness, staff clean every day and sanitize the toys, at the end of the day. There was a Hand Foot and Mouth disease in S6's class, it was one child. The parents informed the staff, and the child was out a whole week. Staff did extra cleaning and checked the other children. S6 heard there might have been a case in another room, but S6 didn’t really know. Page 2 of 3

Staff 7 (S7) stated the procedures for cleaning after there has been an illness is parents are called right away and children are allowed to return with a doctor’s note. Then staff clean the rooms. There was a Hand Foot and Mouth outbreak in the English toddler rooms. S7 think about 2 children were sent home. The other parents in that room were not notified nor the other parents or other staff. The previous director did not notify Licensing. Staff 8 (S8) disclosed the procedures for cleaning after there has been an illness is teachers will contact parents on the app, BrightWheel and ask that they get picked up. Then staff sanitize the classroom and reduce chances of contamination. There was a Hand Foot and Mouth outbreak in the toddler, English class. The parents were notified and about 3-4 children had to be sent home. The other parents and staff were not notified of the outbreak and Licensing was not informed about it, per the previous Director.

LPA reviewed the file and confirmed facility did not notify the Department about the Hand, Foot, and Mouth outbreak from March 2024.

5 of 8 parents were interviewed, 5 of 5 parents interviewed had no issues or concerns with the facility. 5 out of 5 children stated teachers clean the classrooms every day.

Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur; therefore, the allegations are UNSUBSTANTIATED. Exit interview was conducted, and report was reviewed and discussed. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100 per day. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.

The previous director did not notify Licensing.” Staff 8 (S8) disclosed there was a Hand Foot and Mouth outbreak in the toddler, English class. The parents were notified and about 3-4 children had to be sent home. The other parents and staff were not notified of the outbreak and Licensing was not informed about it, per the previous Director.

LPA reviewed the file and confirmed facility did not notify the Department about the Hand, Foot, and Mouth outbreak from March 2024.

Based on interviews conducted, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12, Chapter 1 Section CCR 101212(d)(1)(E)Reporting Requirements, 1 Type B is being cited on the attached LIC 809D. Please refer to attached 809D for documentation of deficiencies.




Exit interview was conducted. The Notice of Site Visit was posted. Appeal Rights were explained. A copy of appeal rights (LIC 9058 1/16) was provided and their signatures on this form acknowledges receipt of these rights. First level appeal is to Regional Manager, address is above on the report.
