32 | LPA Observations:
During initial investigation on 2/21/24, while LPA was doing the walk-through with the Director, at 9:17am, LPA observed classroom # 5 with 14 children and 1 staff. Staff #1 (S1) stated that the other staff, Staff #2 (S2) was on break. The director also stated that S2 was on break. LPA advised the director to stay in Room#5 to be in ratio. LPA took a photo of the class.
Based on LPA observation, inspection and interviews conducted with 2 staff, it has been determined facility has operated out of ratio. Therefore, the preponderance of evidence standard has been met, the above allegation is found to be Substantiated. California Code of Regulations, Title 22, 101216.3(a) Teacher-Child ratio is being cited on the attached LIC 9099D.
LPA Chan informed Director Khannia Ok, that this report dated 02/21/2024 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed Director to provide a copy of this licensing report dated 02/21/2024 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
An exit interview was conducted, and the report was reviewed with Director Khannia Ok. Notice of Site Visit was posted during the visit. The director was informed that the notice of the site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100.
Appeal Rights were explained. The Licensee was provided a copy of appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
