32 | During the course of investigation, LPA interviewed 5 staff members and 2 parents.
During staff interviews, all five staff denied violating a child’s personal rights.
Staff #1 (S1) stated that Parent #1 (P1) reported Child #1 (C1) said Staff #4 (S4) pinched C1. Approximately three weeks prior, P1 showed S1 a photo of a bruise, which appeared older and not fresh. S1 informed P1 that S4 was being moved out of the classroom. On February 5, P1 raised concerns again; however, C1 had not been with S4 since January 20, and C1’s attendance was inconsistent. S1 stated the bruise did not appear consistent with a pinch, as there were no nail marks and it appeared older, suggesting C1 may have hit a hard surface. S1 reported that on C1’s last day, Staff #3 (S3) indicated no incident occurred. Staff #2 (S2) stated that C1 reported being hurt but was often the aggressor. S2 indicated that incident reports were not consistently completed, and P1 was not aware of C1’s behavior. P1 also reported that C1 stated someone hurt C1’s hand/wrist. Staff #3 (S3) denied observing any violations of children’s personal rights. Staff #4 (S4) described C1 as very active and sometimes aggressive with peers. S4 denied pinching C1 or observing any pinching involving C1 and did not recall observing any bruises. Staff #5 (S5) denied observing any violations of children’s personal rights. S5 described C1 as rarely attending, physically strong, and sometimes aggressive with other children. S5 reported observing C1 hitting and pinching other children and had no concerns regarding S4’s care of children.”
Two out of five parents were contacted, two of two parents interviewed had no issues or concerns with the daycare.
LPA obtained a copy of the Children’s Roster, Personnel Report, Parent Handbook and a copy of child #1’s file.
Based on LPA’s interviews and record review, there is insufficient evidence to corroborate the allegation of Staff pinched daycare child. Although the allegations may have happened or is valid, there is not a preponderance of evidence to prove the alleged violation did or did not occur; therefore, the allegation is UNSUBSTANTIATED.
Exit interview was conducted, and report was reviewed and discussed with Director, Sun "Stella" Chung. Notice of Site Visit was posted during the visit. The facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. The facility was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights. End of Report.
