Licensing Program Analyst (LPA) Cynthia Sun conducted a follow up investigation regarding the above allegations. This is a follow up for the visit conducted on 5/31/24. LPA met with the Director, Angelica Burgos and , Area DirectorMaria Rodriguez There was a total of 12 preschool children and 3 staff present at the facility.
A review of staff records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 5/21/2024, Orange County Regional Office received a complaint alleging staff handled daycare child in a rough manner and staff spoke inappropriately to daycare child. The Reporting Party (RP) stated that on 5/6/24, a staff (RP didn’t know name of staff) put their hand on the child’s right shoulder, then forced the child to the ground and told child to pick up the blanket. RP stated, during incident the staff told child that child was going to make the staff mad.
LPA contacted the RP to obtain additional information and RP stated: On the evening of May 6th approximately around 7:00 PM, child said that teacher pushed child down. RP told child to show how teacher did it? Child demonstrated to RP with older sibling. Child placed hand on left shoulder of sibling, pushing down forcing sibling to the ground to pick up a blanket.

During the investigation, LPA interviewed 4 staff members, 3 children, 7 parents, and reviewed records which include Child Care Roster.

During the interview, Director disclosed the following: On 5/7/2024, Staff #1 (S1) text director stating Parent #8 (P8) came into facility around 8:00 AM, P8 was upset and saying, someone touched Child #1 (C1). P8 was also cursing and said, no one should be touching C1. P8 wanted to talk to the teacher. S1 didn’t know which teacher P8 was referring to S1 was trying to calm P8 down. P8 was more upset because S1 didn’t know who P8 was talking about. P8 was cursing in front of the kids. No one witnessed it. Director immediately called P8 and P8 didn’t answer the call.

During the staff interviews, 3 out of 4 staff interviewed stated they have not witnessed anyone handling a daycare child in a rough manner or speaking/yelling inappropriately at a child (ren). S1 confirmed all the information regarding the incident happened on 5/7/2024 disclosed by director was correct. S1 also stated: “We don't touch C1. Other children guide C1 if C1 doesn't want to go to the bathroom, sleep, or eat. Staff verbally guide C1. If C1 stands there and doesn't move, another student will take C1 by the hand. For lunch and nap other kids will help C1. For lunch, staff tell C1 food is here or other kids will guide C1. Teachers always talk to children. Once when C1 didn't want to pick up the blanket, a friend/peer would help C1 clean up blanket.” S2 stated: “C1 is quiet, stands like a statue, and doesn't follow directions. Other kids take C1’s hand. Kids guide C1”. LPA requested to interview C1 and was advised C1 would not talk to any other adult, except for C1’s parents; thus, no interview was conducted with C1.

During the children interviews, 3 out of 3 children interviewed stated C1 doesn’t talk. Children were asked during interview if they remember C1? Child #2 stated: “C1 doesn't come because C1 is almost a big kid. C1 doesn't talk”. Child #3 stated: “C1 doesn't talk when we are doing learning or play tag”. Child #4 stated: “C1 is my friend, doesn't talk. C1 talk outside. C1 said "No" to hide and seek”. 3 out of 3 children interviewed denied witnessing anyone being mean to C1.

LPA contacted 13 parents and LPA was only able to interview 7 parents. 7 parents did not make any disclosure regarding the above allegations and did not have any concern.

LPA obtained and reviewed the Anaheim Police Report. The case was closed due to insufficient evidence.

Based on LPA’s observation, interviews, and record reviewed, it was determined there was insufficient evidence that staff handled daycare child in a rough manner and staff spoke inappropriately to daycare child. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove the alleged violations did or did not occur, therefore the allegation are Unsubstantiated.

Exit interview conducted and report was reviewed with Director. Notice of Site Visit was posted and must remain posted for 30 days. Failure to comply with the posting requirements shall result in an immediate civil penalty of $100.

Appeal Rights were explained. The Director was provided with a copy of the appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. First level appeals should be sent to the regional manager to the address listed above.
