32 | Regarding allegation (1) Lack of supervision resulting in daycare child sustaining an injury during LPA’s observations on supervision, LPA observed teachers and assistants providing supervision during indoor/outdoor activities. All three (3) staff provided consistent statements about following facility’s supervision procedures outlined in the “Little Minds Staff Training & Licensing Requirements Meeting”. The staff present during the incident states they witnessed the incident and provided immediate medical attention. LPA Castro observed facility staff continuously scan the environment and monitor behavior as mentioned in the same training. Out of the five (5) eligible child interviews, none of the children disclosed concerns regarding supervision. The two (2) interviewed parents did not disclose any concerns regarding lack of supervision. During record review, LPA examined Supervision procedures.
Regarding allegation (2) Unsafe environment, personal rights, during LPA’s observations, LPA observed facility staff attentive to the children and their needs. All three (3) interviewed staff provided consistent statements about acknowledging and honoring children’s personal rights. All five (5) children provided consistent statements about having positive experiences and interactions with their teachers. The two (2) interviewed parents did not disclose any concerns regarding the allegation that the facility is an unsafe environment, personal rights. During record review, LPA Castro examined Section III of the staff training that outlines Personal Rights of Children which describes the following, but not limited to: be treated with dignity and respect, feel safe, secure and supported and safe and healthy environment.
The Orange County Regional Child Care Licensing Office has investigated the complaint alleging that staff do not provide adequate care and supervision and unsafe environment, violation of personal rights. Based on the information gathered from LPA’s interviews and record reviews, although the allegation may have happened or is valid, there was not a preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is unsubstantiated.

A notice of site visit was given and must remain posted for 30 days.
