Licensing Program Analysts,(LPA) P. Rivas conducted an unannounced annual inspection. Upon arrival Lead Infant teacher Sonia Tobar and Teacher's assistant were serving breakfast to 4 children in the main room. At 7:30 Two children were pre schoolers (ages 2 & 3 years old )and two children were school age( 7 &8 years old). Between 7:35 and 8:00 am four children between the ages 2 and 4 years old arrived. LPA Castanon arrived at 8:05 am and The Director arrived shortly thereafter to assist LPAs with inspection. The room in which the above was observed is licensed under license#304371467.
LPA's were provided tour of Infant room 1(Squirrel Room) and 2 (Rabbit Room). at 8:15 am LPAs observed 1 teacher and one infant in room #1; 1 teacher and 5 toddlers in room 2. Later at 10:34 am LPAS were going to be shown the outside activity area for the toddlers and were guided through Rabbit room and LPAs observed 1 staff and 7 children in care. Citation under H & S 1596.956(a)4 Child Day Care Centers Serving Infants; optional Toddler program; departmental guidelines and regulations (staff and child ratio) is cited on 809(d).
During inspection, LPAs had advised Director to assist LPAs when she was able. Throughout visit Director did assist her staff.
A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions
During the inspection of the indoor activity space, items which could pose a danger to children (detergents, cleaning compounds, and medications) were observed to be stored out of the reach of children locked in cabinets. Poisons/Hazardous Items are not kept on the premises. All storage containers for solid waste, including moveable bins, have tight fitting covers that are kept on, and are in good repair. Bottles, dishes and containers of food brought by the infant’s authorized representative are labeled with the infant’s name and current date. Food is prepared on site; lunch and snacks are provided. Food prep areas were clean and sanitary. Food is properly stored and labeled. Menus were posted where they could be reviewed by parents. Floors, equipment, and furniture were clean and were observed to be in good repair and free of sharp edges. There is drinking water available to children indoors via bottles with the child’s name on it. The

Based on observation At 10:35 am LPAs observed water going into hallway and into infant room from outside due to rain. LPAs observed staff mopping infant room in nap area under cribs and water accumlated in hallway., the licensee did not comply with the section cited above which poses/posed a potential health, safety or personal rights risk to persons in care.

licensee came into building and added a weather strip at bottom of door way. Director states scheduled maintenance for Saturday will fix door and or framing so as not to allow water to enter. If water does enter prior to Saturday, use of trash can to catch water, will use materials to obsorb water until fixed. and signs advising of wet floor.

The last child to enter which was documented at sign in sheet was at 10:14 am. the licensee did not comply with the section cited above based on observation which poses/posed a potential health, safety or personal rights risk to persons in care.

Director immediately became part of staff. Director will provide plan which includes but is not limited to; Director will add an additional phone in toddler room and staff to call director immediately when 7th child enter and will being hiring one additional staff.(provide time frames)

children's bathrooms are clean and sanitary. Infant changing tables are placed within arm’s reach of a sink and have at least 1 inch cushion mat and 3 inches border. The facility has age appropriate furniture and equipment including, but no limited to, cribs, cots, or mats, changing table and feeding chairs. A baby walker was not observed during today’s visit. Director reports there is no smoking allowed in facility.
The Director was advised that bedding sufficient to change daily is required. A technical advisory is being issued.
The facility has indoor activity space for infants that is physically separate from space used by preschool childcare center. The toddler program is conducted in areas physically separate from those used by older or younger children. The facility has conducted an emergency drill within the past six months on January 2022. The facility has a working carbon monoxide and smoke detector and fire extinguisher. Facility met all posting requirement. The California Child Passenger Safety Law was posted by the entrance of the facility.
During inspection LPAs observed water coming into infant room and hallway from the outside accumulating on floor. A Citation under Buildings and Grounds is being issued. LPAs viewed an outside fence under four feet, a technical violations being issued as Director reports this is how the facility was licensed.

Staff files were reviewed for staff present during the facility inspection this date; 3 staff files were reviewed. Health screening and immunization's as required were reviewed. Beginning September 1, 2016, Health and Safety (H&S) 1597.622 states, a person shall not be employed or volunteer at a child care center if he or she has not been immunized against influenza, pertussis, and measles. Proof of immunization against pertussis, measles for 3 staff were reviewed and within compliance. Beginning March 31, 2018, H&S Code 1596.8662 requires all directors and employees to complete mandated reporting training, and to renew the training every two years. One out of three staff files had an expired Mandated Reporter Training, the one expired in 2021 but at end of visit Director showed a certificate completed on today's date.. A technical violation is being issued as staff was out of compliance since 2021. Director present possesses current EMSA approved Pediatric CPR/First Aid certifications, which expires 08/2023.

Children's records were reviewed, and there was a separate, complete and current record for each child. A random sample of 6 children's files were reviewed for documentation of the child’s name, address, and telephone number of the child’s authorized representative and of relatives or others that can assume responsibility for the child if the authorized representative cannot be reached when necessary (LIC 700)

Sign in/out procedure was reviewed for compliance. A technical advisory was provide in 4 out of 4 sign in sheets reviewed did not have today's sign in. At approximately 7:40 am LPA Rivas observed staff reminding a parent to sign in and parent refusing to sign in .

LPAs left facility from approximately 1:00pm until 3:30pm to write reports and take lunch.

Incidental Medical Services (IMS) policy was discussed. As of today no children are taking medication. For IMS information see PIN 22-02-CCP: Best Practices Related to the Provision of Incidental Medical Services in Child Care Centers and Family Child Care Homes When any IMS is provided, an updated Plan of Operation that includes IMS must be submitted to the Department.

Information on the additional nutrition training, immunization requirements for children, and Health Schools Act (http://www.cdpr.ca.gov/docs/pestmgt/schoolipm.htm) were provided. The director was informed, and website given, about the California Child Care Disaster Plan has been posted to the UCSF California Childcare Health Program website: cchp.ucsf.edu/content/disaster-preparedness Also provided was information about the E-Learning Modules available at https://ccld.childcarevideos.org A copy of the California Department of Social Services Lead Information Brochure was explained and provided to the facility representative. Facility Director does/does not have lead training Certificate.

LPA discussed the safe sleep regulations with director and discussed the Child Care Licensing Safe Sleep webpage at https://www.cdss.ca.gov/inforesources/child-care-licensing/public-information-and-resources/safe-sleep as an additional resource. LPA also informed director of the importance of checking for recalled infant devices on the United States Consumer Product Safety Commission (CPSC) website at https://www.cpsc.gov/ and recommended they register all infant devices with the CPSC to be notified of any recalls on their purchased equipment.
Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

The following deficiencies are cited under the California Code of Regulation Title 22 Division 12 (on lic 809d) ; 1596.956 (a) 3 and (a)4 Child Day Care Centers serving Infants: Optional toddler program; 101238(a) and (b) and 101417(a)(1)

Appeal Rights were discussed. Ms. Lucero Rubi was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Failure to comply with posting requirements shall result in an immediate civil penalty of $100. Exit interview conducted and report was reviewed with the licensee.
