On 06/09/2026, a follow-up proof of correction inspection was conducted by Licensing Program Analyst (LPA) Castro and Licensing Program Manager (LPM) Tran to clear the deficiency cited on 06/03/2026. An initial visit was conducted on 06/03/2026 where the facility was cited a type A deficiency for Regulation 101216.3(a) – Teacher-Child Ratio. Staff #1 (S1) and Staff #2 (S2)'s qualifications were reviewed with the Director. It was determined that S1 and S2 were not fully qualified teachers and Director were made aware that S1 and S2 should not be allowed to be in the classroom supervising children by themselves. Director stated they would submit a detailed plan and schedule to ensure the facility complies with staff to child ratios. The Plan of Correction was due on 06/05/2026. As of 06/08/2026, LPA Castro has not received the Plan of Correction as discussed.

Upon arrival at 8:50 am today, as LPA Castro conducted inspection of the school age classroom, LPA Castro observed Staff #2 (S2) was leaving the school age classroom and Staff #5 (S5) entered the school age classroom, upon interview, S5 stated S5 arrived to work today at 8:50am and prior to her arrival, S2 was providing care and supervision of the six school age in the school age classroom by themselves.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

Director Angelica Burgos arrived at the facility at 9:30am and met with LPA Castro and LPM Tran. Director was informed of the purpose of the visit.

Director informed LPA and LPM that Director read through the report dated 06/03/2026 and was not in agreement with one of the report findings. LPM Tran advised the Director of the appeal rights provided on 06/03/02026.

When asked about the Plan of Correction that was not submitted as discussed on the due date, Director shared the facility had been very busy and could not work on submitting the plan of correction, however stated a change in schedule had already been implemented to ensure teacher-child ratio are being met at all times. Director also shared that during the exit interview on 06/03/2026, while Director was providing supervision for the children on the playground, the children were loud and the Director was not hearing all of the report that was reviewed, therefore, Director thought that the plan was not due until 06/12/2026.

LPA Castro conducted physical plant inspection and observed Notice of Visit posted for 06/03/2026, however did not observe the report documented the Type A deficiency dated 06/03/2026 being posted. When interviewed, Director stated Director was not aware that the report of the type A violation is required to be posted. LPM Tran advised the Director that it was documented on the report dated 06/03/2026 that "Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00".

At 9:50 am, Area Director (AD) Maria Rodgriguez arrived at the facility and met with LPA Castro and LPM Tran. AD infomed LPM Tran and LPA Castro that facility had hired an attorney and the attorney requested to speak with LPA Castro and LPM Tran. LPM Tran responded that Department can arrange a meeting with the attorney at the Orange County Regional Office. AD stated the attorney wanted to speak with licensing staff right now and proceeded to dial a video call on her phone and put the phone screen toward LPA Castro and LPM Tran's direction. The gentleman on the phone screen did not introduce themselves and started to question the reason why Department's staff conducted visit at the facility and accused the licensing staff of harassing the facility staff. The gentleman also stated that licensing staff are not allowed to interview facility staff without his presence. LPM Tran declined to respond to the inquiry as the gentleman on the screen appeared to be driving and let AD know that an in-person meeting is needed to discuss their concerns.

Area Director left the facility at 10 am, shortly after the call was ended. At 10:05am, AD Rodriguez called facility Director Burgos and instructed Director Burgos not to sign any reports provided during visit today.

When LPA Castro requested to review children's files to check for LIC 9224 Acknowledgement of Receipt of Licensing Report, Director went to the Director's office and returned with the phone on. On the voice phone speaker was a gentleman by the name of Hari, who introduced themselves as the owner of the facility, the owner questioned LPA Castro why the children's files were being reviewed over and over. Owner stated this is a harassment when the file reviews were being conducted, LPA explained that the files reviews are needed to ensure the facility has followed up with posting requirements to provide the 06/08/26 report which documented the Type A violation. The owner stated they would make a complaint to the governing agency and instructed the Director to provide the children's files for the LPA to review. The Director stepped away and later on responded to LPA Castro and LPM Tran that they did not have the LIC 9224 signed by children's representatives. Director stated that they were under the impression that they had 30 days to collect the signed LIC 9224 from the children's representatives.

Based on observations and interviews during today's visit these are the following deficiencies:

1- S2 (who was not qualified as a teacher) was providing care and supervision for six school age children in the school age by themselves prior to 8:50am. This is a violation of teacher-child ratio.

2- The report dated 06/03/2026, which documented a Type A violation for Teacher-Child Ratio was not posted in the facility. This a violation of posting requirement - Health and Safety Code Section 1596.8595 Posting licensing report by child care facility or home; duration of posting; civil penalty for failure to comply; reports to be provided to parents or guardian of each child receiving services.

3- The LIC 9224 Acknowledgement of Receipt of Licensing Report were not available due facility has not obtained the signed document. This a violation of posting requirement - Health and Safety Code Section 1596.8595 Posting licensing report by child care facility or home; duration of posting; civil penalty for failure to comply; reports to be provided to parents or guardian of each child receiving services. This a violation of posting requirement - Health and Safety Code Section 1596.8595.

During today's inspection, LPA Castro was not able to clear the deficiency. The facility failed to correct the deficiency. LPM Tran provided consultations to Director Burgos and advised Director that the implemented plan for schedule change did not suffice, hence the facility continued to have violation.

A civil penalty of $250 was assessed for failure to correct the Type A violation cited on 06/03/2026 and $100 was assessed for failure to post the report dated 06/03/2026, which documented the Type A violation.

Due to the Type A violation, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file. Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00

An exit interview was completed. Appeal Rights were provided. The director was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00.
