On 06/09/2026, a Case Management was conducted at the facility to address a violation of personal rights observed during a visit on 06/03/2026 visit. Licensing Program Analyst (LPA) A.Castro and Licensing Program Manager (LPM) Tran met with facility representative, Angelica Burgos. Census was taken as follows: six school-age children and one staff member in the school age classroom.

A review of the Facility Personnel Report Summary on this date indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions. Director was reminded that all adults 18 and over, including employees and volunteers, must obtain a criminal record clearance or exemption, or transfer their existing clearance or exemption, prior to initial presence in a Child Care Center. A civil penalty of $100.00 minimum/day up to $500.00 maximum per day/per person will be assessed if this regulation is violated.

During the visit conducted on 06/03/2026, Director Burgos was observed providing breaks for the facility staff in classrooms and supervising children in facility playground to support staff in meeting teacher-child ratio. Director also provided transportation support by picking up school aged children and transporting them to the center. Therefore, it was time consuming for Director to respond to LPA’s requests to provide the documentation needed for file review. Director also stated that there was not an available printer at the facility to print out the transcripts for the staff and provided screen shots of staff’s transcript for review over the Director’s phone. LPM reviewed present staff transcripts with the Director and provided consultation to ensure the Director understood the required qualifications for current staff so they can be scheduled in the classrooms according to their qualifications.

FACILITY EVALUATION REPORT California law requires a public report of each licensing visit/inspection. This report is a record for the facility and the licensing agency. This report is available for public review; therefore, care is taken not to disclose personal or confidential information. Inquiries concerning the location, maintenance, and contents of these reports may be directed to the Licensing Program Analyst or Regional Office whose address and telephone number are listed on the front of this form.

DEFICIENCIES A deficiency is an instance of noncompliance with licensing requirements, including applicable statutes, regulations, interim licensing standards, operating standards, and written directives. Applicants/ licensees must be notified in writing of all licensing deficiencies. Deficiencies are listed on the left side of this form, and the applicable licensing requirement upon which the deficiency is identified. There are two types of deficiencies:
  • Type A deficiencies are violations of licensing requirements that, if not corrected, have a direct and immediate risk to the health, safety, or personal rights of persons in care.
  • Type B deficiencies are violations of licensing requirements that, without correction, could become a risk to the health, safety, or personal rights of persons in care, a recordkeeping violation that could impact the care of said persons and/or protection of their resources, or a violation that could impact those services required to meet the needs of persons in care.

PLANS OF CORRECTION (POCs) The licensing agency is required to establish a reasonable length of time to correct a deficiency. In order to set the time, the licensing agency must take into consideration the seriousness of the violation, the number of persons in care involved, and the availability of equipment and personnel necessary to correct the violation. Applicants/licensees are requested to provide a specific plan for each violation on the right side of the form across from each deficiency. The more specific the plan, the less chance exists for any misunderstanding in setting time limits and reviewing corrections. The applicant/licensee who encounters problems beyond their control in completing the corrections within the specified time frame may request and may be granted an extension of the correction due date by the licensing agency.

CORRECTION NOTIFICATION The applicant/licensee is responsible for completing all corrections and promptly notifying the licensing agency of corrections. Applicants/licensees are advised to keep a dated copy of any correspondence sent to the licensing agency concerning corrections, or if corrections are telephoned to the licensing agency, the date, person contacted, and information given.

CIVIL PENALTIES The licensing agency is required by law to issue a Penalty Notice, when applicable, to all facilities holding a license issued by the licensing agency, or subject to licensure, except Certified Family Homes, Resource Families, and Foster Family Homes, or any governmental entity.

PENALTY NOTICE GIVEN The statement concerning civil penalties serves as a penalty notice on this Licensing Report and failure to correct cited licensing deficiencies will result in civil penalties. Applicants/ licensees are required to pay civil penalties when administrative appeals have been exhausted and in accordance with any payment arrangements made with the licensing agency.

APPEAL RIGHTS The applicant/licensee has a right without prejudice to discuss any disagreement in this report with the licensing agency concerning the proper application of licensing requirements. The applicant/ licensee may request a formal review by the licensing agency to amend or dismiss the notice of deficiency and/ or civil penalty. Requests for review shall be made in writing within 15 business days of receipt of a deficiency notification or civil penalty assessment. Licensing deficiencies may be appealed pursuant to the procedures in the LIC 9058 Applicant/Licensee Rights.

AGENCY REVIEW The licensing agency review of an appeal may be conducted based upon information provided in writing by the applicant/licensee. The applicant/licensee may request an office meeting to provide additional information. The applicant/licensee will be notified in writing of the results of the agency review within 60 business days of the date when all necessary information has been provided to the licensing agency.

EMAIL REQUIREMENT Adult Community Care Facilities, Residential Care Facilities for the Chronically Ill, and Residential Care Facilities for the Elderly are required to provide and maintain an active email address of record with the licensing agency.

At approximately 5:15pm on 06/03/2026, during the exit interview, LPA Castro and LPM Tran observed Director and one other staff supervising playing school age children and preschool children on the facility playground. The facility has an approved waiver for commingling the school age and the preschool children between 4:30pm and 6pm on the playground. As LPA Castro reviewed the reports with Director Burgos, Director Burgos instructed the school-age children to sit by the wall. LPA Castro and LPM Tran observed six school age children were sitting down by the facility’s fence, two of the school age children were falling asleep. One of the school-age children asked Director if they could go play, the Director responded to them to give her five minutes. When the five minutes mark passed, the child told the Director, “It’s been more than 5 minutes”. Director let LPA and LPM know that she kept the children sitting by the fence for their safety since she is listening to LPA reading the report. Director asked if a child did not follow direction and was placed on Thinking Time, LPM Tran explained to the Director the facility was granted a waiver to allow both preschool and school age children to share the playground during the designated time. If a child is not following directions, facility staff can follow facility’s discipline policy to assist a child to make a positive choice; however, asking all of the present school age children to sit down by the fence, is a violation of their personal rights. Director thanked LPM Tran for explaining and allowed the school age to go back onto the playground to play back into playing on the playground.

Due to time constraints, the observed deficiency on 06/03/2026 visit was cited during today’s visit.

During today’s visit, when informed about the deficiency, Director stated she asked the children to sit by the fence, for safety reasons, due to the Director was meeting with licensing staff to review the reports, and stated licensing staff should have rescheduled to provide the report to the Director at a later time since Director was supervising children. LPM Tran reminded the Director of the Director’s role and responsibility as the facility representative during Department’s visits.

Based on information gathered from 06/03/2026 observations and interview with Director, the facility was observed to have violated the children’s personal rights. California Code of Regulation Section 101223 (a)(2) is being cited.

Due to the Type A violation, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file. Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00

A notice of site visit was posted today, and licensee was explained, that it must remain posted for a period of 30 days. Failure to keep a Notice of Site Visit posted will result in a $100.00 civil penalty. An exit interview was conducted, and a copy of this report was provided to director. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights.
