32 | During investigation, LPA interviewed five (5) staff and ten (10) parents. Three (3) out of five (5) interviewed staff confirmed that they had witnessed the facility operating out of ratio, including center director. Director disclosed that on a few occasions, Staff 4 (S4) had picked up the children earlier than S4 was supposed to, resulting in the facility being out of ratio for a short period of time. Two (2) interviewed staff denied that the facility had operated out of ratio. Three (3) out of ten (10) parents did not disclose any concerns regarding the above-named allegation. The other seven (7) parents did not answer or call LPA back.
During LPA’s record review, LPA obtained and cross-referenced staff and children attendance records, which indicated there was at least one day (04/13/2026) that the facility was not operating within compliance of staffing ratios. The facility's preschool and school age components share the playground on a previously-granted waiver authorizing co-mingling between the two age groups from 4:30pm-6:00pm. It was determined that the facility was operating out of ratio during that intended time. Furthermore, LPA Castro also obtained staff communication indicating the facility was operating out of ratio.
The Orange County Regional Child Care Licensing Office has investigated the complaint alleging staff is operating out of ratio. Based on information gathered from LPA’s interviews and record reviews, the preponderance of evidence standard has been met, therefore the allegation is substantiated. California Code of Regulations, Title 22, Division 12 & Chapter 1, Section 101216.3(a) Teacher-Child Ratio is being cited; see LIC 9099D.
Due to the Type A violation, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file. Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00
A notice of site visit was given and must remain posted for 30 days.
