Facility is falsifying daycare children's records

On May 24, 2022, Licensing Program Analysts (LPAs), Mila Quinto and Dianna Valdez Santana conducted an in-person inspection to deliver the finding regarding the above complaint allegation. LPAs met with director Quashanika Marin. The Covid-19 Emergency Response questionnaires were asked. A tour around the facility was conducted, and a census was taken. Observed at the time of the visit was a total of 14 children and 5 staff members. A review of staff criminal clearance records on this date indicated that all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.
On 4/19/2022, the Department received a complaint alleging the facility is falsifying daycare children's records and Staff are not allowing parents inside the facility. Reporting Party (RP) stated Parents have to wait outside when dropping off and picking up their child due to COVID 19. RP also disclosed, not being allowed to go inside the facility when RP asked to go inside the facility. RP also stated facility is also altering children's birthdate and making them older age, because facility does not have an infant licensee.

During the investigation, LPA Nguyen and LPA Tran interviewed four staff members and four parents. No children were interviewed due to being non-verbal.

Four interviewed staff stated due to Covid 19, parents drop off and pick up their children at the gate to make sure children are provided a safe environment. Parents are allowed to come inside the facility, but no parents have requested to come inside the facility.

Four interviewed parents stated due to Covid 19, they do not come inside the facility when they drop off or pick up their children. They also disclosed they did not request to come inside the facility during drop off or pick up time.

Regarding allegation “facility is falsifying daycare children's records”, S1 stated the facility did not alter any documents. The facility is using the “Sandbox” software to enter all the children’s confidential information, such as birthday and enrollment date. It must be the computer glitches if the children’s birthday were incorrectly reflected on Sandbox software.

LPA Nguyen reviewed Child #6’s (C6) confidential forms in the file including Emergency form, Physician Report form, and the Immunization record. LPA Nguyen was able to verify that C6’s birthday was incorrectly reflected on Sandbox Software. C6’s is 19 months old and Sandbox software posted as 28 months old. Since C6 is 19 months old, C6 qualified to be enrolled in the program; thus, facility did not need to alter the child’s birthday to enroll the child into the program. This indicated there’s a glitch with either the computer or the software.
Based on the information gathered from LPAs' interviews, reviewing records, and LPA’s observation, there was insufficient evidence to corroborate the allegations. Although the allegations may have happened or are valid, there is not a preponderance of evidence to prove facility is falsifying daycare children's records and staff are not allowing parents inside the facility did or did not occur, therefore the allegations are UNSUBSTANTIATED.

Exit interview was conducted. The Notice of Site Visit was posted. Facility representative was informed that the Notice of Site Visit must be posted for 30 consecutive days. Failure to post will result in civil penalty of $100. “The licensee was provided a copy of their appeal rights (LIC 9058 12/15) and their signature on this form acknowledges receipt of these rights.” This report LIC 9099 was provided to the director. First level appeal is to Regional Manager, address is above on the report. Facility was advised on how to receive notifications for quarterly updates and provided with Child Care Advocate contact information: childcareadvocatesprogram@dss.ca.gov
