During the investigation, LPA reviewed video recordings taken on 11/15/2024, from classroom #121. While reviewing the video, LPA observed one teacher caring for 13 preschool age children at 11:02 AM. LPA then observed another preschool age child being dropped off at 11:04 AM inside classroom #121, making the ratio 14 children with one teacher.
On 11/19/2024, LPA toured inside classroom #116 at 8:58 AM and observed 13 preschool age children with one teacher. LPA then observed the teacher taking one child out of the classroom and walking the child over to classroom #117 to get back into ratio.
Children were not interviewed due to age and being non-verbal.
Based on staff interviews and observation of video recordings; the preponderance of evidence standard has been met; therefore, the above allegation alleging (1) Facility is operating out of ratio is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division & Chapter 12, is being cited on the attached LIC 9099 D for the deficiency section 101216.3 Teacher-Child Ratio there shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance. The facility is being assessed a civil penal for the amount of $250.00 for a repeat violation cited on 9/26/2024.
In the areas that were evaluated, one Type A deficiency was observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit.
LPA Dean Thompson informed Director Christina Naffziger that this report dated 11/19/2024, document(s) one Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.
Also, LPA Dean Thompson informed the Director Christina Naffziger to provide a copy of this licensing report dated 11/19/2024, that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.

Notice of Site Visit was provided to Director Christina Naffziger and posted on the door. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The licensee was provided a copy of their appeal rights (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights. |
