Licensing Program Analyst (LPA) Thompson conducted an unannounced complaint investigation. This is a continuation of the investigation initiated on 9/12/2024. Upon arrival LPA met with Director Christina Naffziger, to deliver complaint findings. Director guided LPA on a tour of the facility. LPA observed a total of 13 Preschool age children with 3 staff.

A review of the Facility Personnel Report Summary indicates all facility staff or other individuals who required caregiver background checks have received criminal record and child abuse index clearances or exemptions.

The Orange County Childcare Office received a complaint 9/5/2024, with two allegations (1) Staff left day care children unattended and (2) Staff did not ensure required ratios were maintained.

During the investigation LPA interviewed six staff, interviewed three parents, and obtained the facility roster.

Reporting Party (RP) stated Staff left day care children unattended. On 9/12/2024, LPA interviewed six staff. Three out of six staff stated they have they have left children alone inside the classroom when they are assisting another child inside the restroom or changing a child. Staff reported when they ask for assistance from the front office, sometimes staff do not come or they arrive after they have assisted a child in the restroom. One staff stated they have witnessed a child being left on the play yard alone.

Reporting Party (RP) stated staff did not ensure required ratios were maintained. On 9/12/2024, LPA interviewed six staff. Three out of six staff stated they have been out of ratio. Four out of six staff interviewed stated they have witnessed other staff being out of ratio. On 9/12/2024, LPA reviewed records where a teacher had informed front office staff they were out of ratio.

On 9/16/2024, LPA contacted nine parents via phone call. Three parents were able to be interviewed. One out of the three parents interviewed stated they have observed one staff caring for 13 to 14 children alone in the morning during drop-off.

Children were not interviewed due to age and being non-verbal.

Based on staff interviews, parent interviews and records reviewed; the preponderance of evidence standard has been met; therefore, the above allegations alleging (1) Staff left day care children unattended and (2) Staff did not ensure required ratios were maintained are found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division & Chapter 12, is being cited on the attached LIC 9099 D for the deficiency sections 101229 Responsibility for Providing Care and Supervision (a) The licensee shall provide care and supervision as necessary to meet the children's needs (1) No child(ren) shall be left without the supervision of a teacher at any time. Supervision shall include visual observation and 101216.3 Teacher-Child Ratio (a) There shall be a ratio of one teacher visually observing and supervising no more than 12 children in attendance, except as specified in (b) and (c) below.

In the areas that were evaluated, two Type A deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit.

LPA Dean Thompson informed Director Christina Naffziger that this report dated 9/26/2024, document(s) two Type A citation(s) which shall be posted for 30 consecutive days as there is/are immediate risk(s) to the health, safety, or personal rights of children in care.

Also, LPA Dean Thompson informed the Director Christina Naffziger to provide a copy of this licensing report dated 9/26/2024, that documents any Type A citation(s) to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.


Exit interview conducted and report was reviewed with Director Christina Naffziger.

Notice of Site Visit was provided to Director Christina Naffziger and posted on the door. The notice of site visit must be posted for 30 consecutive days. Failure to post will result in civil penalties of $100. The licensee was provided a copy of their appeal rights (LIC 9058 1/16) and their signature on this form acknowledges receipt of these rights.

Reporting Party (RP) stated Staff did not assist day care children with toileting needs. On 9/12/2024, LPA interviewed six staff. All six staff interviewed stated they assist children that needs assistants when children potty.

On 9/16/2024, LPA contacted nine parents via phone call. Three parents were able to be interviewed. Parents interviewed did not divulge any information pertaining to the allegation.

Children were not interviewed due to age and being non-verbal.

Based on LPA interviews with staff and parents, there was not enough evidence to substantiate the allegations.

The Orange County Childcare Office has investigated the complaint alleging Staff did not assist day care children with toileting needs: although the allegation may have happened or is valid, there is not enough preponderance of evidence to prove the alleged violation did or did not occur, therefore the allegation is UNSUBSTANTIATED.

In the areas that were evaluated, no deficiencies were observed of the California Code of Regulations, Title 22, Division 12 at the time of the visit.
