During staff interviews, three (3) out of five (5) interviewed staff confirmed that they were present when the subject child wandered away. Two (2) out of five (5) staff were not present on the day of the incident, but had heard of the subject child wandering away at a later time. Five (5) out of five (5) interviewed staff provided consistent statements on being trained on supervision. Three (3) out of five (5) staff stated that the child had wandered away for less than two minutes. Two (2) out of five (5) staff stated that the child had wandered away for more than two minutes. Five (5) out of five (5) staff provided consistent statements that the child wandered to the playground and did not exit the premises.
Record review indicates that the incident was reported to the subject child’s parent or guardian via their Parent Portal. Verification was provided to LPA. Facility representative also notified the parent/caregiver by phone on the day that the incident occurred.
The Orange County Regional Child Care Licensing Office has investigated the complaint alleging that a day care child wandered away due to lack of supervision. Based on information gathered from LPA’s interviews and record review, the preponderance of evidence standard has been met, therefore the allegation is substantiated. California Code of Regulations, Title 22, Division 12 & Chapter 1, Section 101229(a)(1) - Responsibility for Providing Care and Supervision – Type B.
Appeal Rights and deficiency was discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with the Director Michelle Nazzareno.
