On 03/21/2024, Licensing Program Analyst (LPA) Tran conducted the 10-Day Initial Investigation at the facility and delivered the findings regarding the above complaint allegation. LPA Tran met with Director Karla Barba. A toured the facility was conducted, and a census was taken. Observed at the time of the visit was a total of 14 preschool children and 3 staff in the Twos classroom and 14 preschool children and 2 staff in the Older Twos classroom.

A review of the Facility Personnel Report Summary on 03/21/2024 indicates all facility staff or other individuals who require caregiver background checks have received criminal record and child abuse index clearances or exemptions.

On 03/20/2024, the Regional Officie received a complaint with allegation that the facility was operating out of ratio.

During the investigation, LPA reviewed staff's qualifications, staff's schedules on 03/20/2024, facility's sign in/out record for the Twos and Older Twos classroom on 03/20/2024, and camera footage of Twos and the Older Twos classrooms on 03/20/2024 from 6:30am to 5pm and the playground of the facility between 9am to 10:30am and 3pm-4:30pm, and interviewed 7 staff members.

During record reviews, the facility's staff schedule revealed that Staff #1 (S1), Staff #2 (S2), Staff #3 (S3), Staff #4 (S4), and Staff #5 (S5) were scheduled to work in the Twos and the Older Twos classrooms. During staff's record reviews, S1, S4 and S5 have qualifications as fully qualified teachers. S2 and S3 do not have any Early Childhood Education (ECE) units. During facility camera footage reviews, LPA Tran and Director observed the following: S1 and S2 were supervising 17 preschool children in the Twos classroom from 9:05am to 9:30am; S3 and S4 were supervising 17 preschool children from 10:50am-3pm in the Older Twos classroom; and the 3 fully qualified teachers S1, S4 and S5 were supervising 34 preschool children in the playground. S2 and S3 also came to the play ground at different times between 9am-10:30am and 3pm-4:30pm.

During interviews, all interviewed staff denied they have worked alone with more than 12 preschool children. Interviewed staff denied they have witnessed S2 and S3 worked alone with the children. S2 and S3 denied that they have ever worked alone with preschool children except for nap time. S2 and S3 stated they did not have any ECE units. Director confirmed that S2 and S3 do not have ECE units and they have not enrolled in any ECE courses. Director confirmed that due to S2 and S3 having no ECE units, the Twos classroom was not in compliance with teacher-to-child ratio (1 teacher and 1 aid without ECE unit: 15 preschool children) between 9:05am to 9:30am and the Older Twos classroom was out of compliance with teacher-to child ratio (1 teacher and 1 aid without ECE unit: 15 preschool children) between 10:50am-3pm, except for during nap time.

Based on the information LPA gathered from interviews with 7 staff on 03/21/2024, and records review of the
staff's qualifications, staff's schedules on 03/20/2024, facility's sign in/out record for the Twos and Older Twos classroom on 03/20/2024, and camera footage of the Twos and the Older Twos classrooms on 03/20/2024, the preponderance of evidence standard has been met, therefore the above allegation about Facility was operating out of ratio, is found to be SUBSTANTIATED. California Code of Regulations, Title 22, Division 12 & Chapter 1, Section 101216.3 (b) Teacher-Child Ratio cited on the attached LIC9099D. (Continue next page)

Due to the Type A violation, the licensee shall post and provide copies of the report to parents/guardians of the children in care at the facility by the next business day, and shall provide to the parents/guardians of children newly enrolled at the facility during the next 12 months. In addition, the licensee shall immediately post upon receipt the Proof of Correction for 30 consecutive days and provide a copy to current and enrolling parents. The licensee is to keep Acknowledgement Receipt (LIC 9224) signed by parents in each child’s file. Failure to post Type A reports for 30 days will result in a Civil Penalty of $100.00

Appeal Rights and deficiency were discussed. The facility representative was provided a copy of their appeal rights (LIC 9058) and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Regional Office within 15 business days. A notice of site visit was given and must remain posted for 30 days. Exit interview conducted and report was reviewed with Director Karla Barba.
