32 | The department received a document confirming the incident did occur while children are at the facility, and staff did not ensure supervision to prevent the incident from happening.
Documents gathered: Children's Roster, Employee Handbook, Parent Handbook, Student and Teacher attendance sheet 3/7-3/11.
Based on video footage reviewed by LPA dated 03/07/25 at 9:14am, for almost 40 seconds, Child 1 (C1) was repeatedly hurt and hit by Child 2 (C2) in the Younger Twos classroom. Staff 1 (S1) and Staff 2 (S2) did not prevent C2 from hitting and kicking C1. Video showed S1 and S2 did not ensure supervision of children in the classroom as S1 and S2 were in the same area of the classroom and facing the opposite direction of the children.
Based on LPAs video observation, record review and conducted interviews, the preponderance of evidence standard has been met, therefore the above allegation is found to be SUBSTANTIATED. A substantiated finding means that the complaint is substantiated, and the allegation is valid because the preponderance of the evidence standard has been met. LPA Chan informed director Karla Barba, that this report dated 03/14/25 documents 1 Type A citation which shall be posted for 30 consecutive days as there is immediate risk to the health, safety, or personal rights of children in care. Also, LPA informed Director to provide a copy of this licensing report dated 03/14/25 that documents any Type A citation to parents/guardians of all children currently enrolled by the next business day or the next day the children are in care, and to any newly enrolled parents/guardians for 12 months from the date of this report. A signed Acknowledgement of Receipt of Licensing Report (LIC 9224), or other written statement, must be placed in the child's file for verification.
An exit interview was conducted with Director Karla Barba. The Notice of Site Visit was posted during the visit. The director was informed that the Notice of Site Visit must be posted for 30 consecutive days. The director was provided a copy of their appeal rights (LIC 9058 01/16) and their signature on this form acknowledges receipt of these rights. First-level appeals should be sent to the regional manager to the address listed above. |
