32 | LPA interviewed 3 staff members. 3 out of 3 staff members stated they have not witnessed the facility administration fail to disclose five type A citations to the parent of a newly enrolled child. S1 stated, The Director or Assistant Director give enrolled parents the report to read and the citations the facility received are explained. The Director or Assistant Director inform that the LIC 9224 (Acknowledgement of Receipt of Licensing Reports) form is stating they are aware of the citations and received the copies of the reports and the parents sign the form, and the copy of reports are given to the parent. The Director or Assistant Director file the LIC9224 in the child's file.
LPA reviewed 5 children files. 5 out of 5 children files had LIC 9224 Acknowledgement of Receipt of Licensing Reports dated: 3/22/24, 5/1/24, 5/20/24 , 5/28/24 and 8/19/24 and signed by parent/authorized representative.
LPA Duron interviewed 4 parents. All interviewed parents stated they did not have any concern with facility.
Based on the information gathered from LPAs’ interviews there is insufficient evidence to corroborate the allegation: The facility administration failed to disclose five type A citations to the parent of a newly enrolled child. Although the allegation may have happened or is valid, there is not a preponderance of evidence to prove the allegation did or did not occur in the day care facility, therefore the allegation is UNSUBSTANTIATED.
An exit interview was completed. The report was reviewed and discussed. Appeal Rights were provided. The facility representative was provided a copy of their appeal rights and their signature on this form acknowledges receipt of these rights. All appeals must be in writing and received by the Licensing office within 15 business days.
The facility representative was informed that the “Notice of Site Visit” must be posted for 30 consecutive days. Failure to post will result in Civil Penalties of $100.00. The “Notice of Site Visit” must be posted on or adjacent to the door.
