32 | During the investigation, LPA interviewed 4 staff and the director and 4 parents. Obtained LIC500, LIC9040 and video footage of the incident.
Reporting Party (RP) stated there is a significant delay in recognizing and addressing child 1 (C1’s) injury.
LPA interviewed 4 staff and the director, Staff 1 (S1) stated they did not observe any marks and redness in the body when they picked C1 up from the ground after sliding down the structure. Staff 2 (S2) stated they observed C1 wobbling and called the Staff 4 (S4) for support. Staff 3 (S3) stated they did not witness any incident with C1. S4 stated they assessed C1’s leg, head and arm and did not notice any fracture. S4 stated they did not observe C1 wobbling their legs because C1 was being carried on their lap or C1 was sitting at the office the entire time C1 was with S4. Director stated they were not present during the incident.
Based on the timeline given by the facility, the incident happened at around 3:25pm on November 18, 2025. At 3:35pm C1 was taken to the office by S4, at 3:40pm child was back in the playground, still crying. S4 assessed child but did not notice injury. At 4:57pm C1 was picked up and child representative noticed C1 could not bear weight on their leg.
LPA reviewed the video footage dated 11/18/25 at 3:30pm. C1 went down the slide alone and C1 was inappropriately positioned having legs opened and not keeping them straight which led C1 to flip over.
LPA interviewed 4 parents and none of the parents interviewed disclosed any information that could support the allegation.
No children were interviewed due to children being non-verbal.
Based on interviews and review of video footage, the preponderance of evidence standard has been met, therefore the above allegation on Staff did not tend to child's injuries in a timely manner is found to be SUBSTANTIATED. See LIC9099D for 1 Type B violation.
Exit interview was conducted with Director Karla Barba. Report was reviewed and discussed. The Notice of Site Visit was posted and must remain posted for 30 consecutive days. Appeal Rights were provided.
